RFP N66604-17-R-0350
Comment Resolution Matrix_28 August 2017
Section / Paragraph Comment / Question Adjudication/ Gov't Response
Section L.1.2 says "No cost or pricing information shall be included in the Offeror's forwarding letter or in any part of its submitted proposal, except the Cost/Price Proposal." However, Amendment 1 to the RFP changed the requirements to include the Small Business Subcontracting Plan as part of Volume III and to require that the Small Business Subcontracting Plan include the cost for each CLIN as provided 83 of 91 and the fee, in dollars, proposed by the offeror for each CPFF CLIN.
Would the Government change Section L.1.2 of the RFP to allow cost information to be included as part of Volume III in the Small Business Subcontracting Plan?
Small Business Subcontracting Plan is removed from Vol III.
The answer to question #25 on page 6 of 23 of the Comment Resolution Matrix states that hand delivery of proposals is acceptable.
However, Section L.1.2(b) and (c) still require that proposals to be provided via mail.
Would the Government update Section L.1.2(b) and (c) to reflect hand delivery of proposals as an option?
The Government has reconsidered the acceptability of hand carry of proposals and has determined hand carry of proposals will not be accepted.
Comment Resolution Matrix_28 August 2017
The Comment Resolution Matrix provided answers that require five solicitation fill-ins to be included with the proposal, but the Amended RFP does not indicate where they are to be included.
Would the Government confirm that the following items should be included as Enclosures to the Cover letter?
a. SF33 (Question 12 on page 3 of 23 of the CRM)
b. Clause 5252.216-9122, Level of Effort, with "TBD" for the fill-in (Question 15 on page 4 of 23 of the CRM)
c. Clause 252.227-7014, Rights in Noncommercial Computer Software and Noncommercial Computer Software Documentation, with "TBD on individual task orders" for the fill-in (Question 35 on page 8 of 23 of the CRM)
d. Clause 252.227-7017, Identification and Assertion of Use, Release or Disclosure Restrictions, with "TBD on individual task orders" for the fill-in (Question 36 on page 8 of 23 of the CRM)
e. Section B CLIN Tables (Question 41 on page 21 of 23 of the CRM)
a. Yes, the SF 33 shall be submitted as an Enclosure to the Cover Letter.
b. Yes, Clause 5252.216-9122 shall be submitted as an Enclosure to the Cover Letter.
c. Yes, Clause 252.227-7014 shall be submitted as an Enclosure to the Cover Letter.
d. Yes, Clause 252.227-7017 shall be submitted as an Enclosure to the Cover Letter.
e. Yes, Section B shall be submitted as an Enclosure to the Cover Letter.
N66604-17-R-0350 Comment Resolution Matrix, Revision B, dated 08-16-2017, page 6, Question 25 & Revised N66604-17-R-0350 Sections L&M, dated 21 August 2017, Paragraphs 1.2(b) and 1.2 ( c)
The answer to question 25 of the referenced CRM indicates that hand delivery of proposals is acceptable. Please confirm the address for hand delivery and the point of contact with whom we should make arrangements to hand deliver. The revised Section L only states that proposals should be submitted by mail.
The Government has reconsidered the acceptability of hand carry of proposals and has determined hand carry of proposals will not be accepted.

HQ C-2-0037 ORGANIZATIONAL CONFLICT OF
INTEREST (NAVSEA) (JUL 2000)
We believe that this subparagraph (e) should be modified to apply only to Systems Engineering and Technical Assistance (SETA) task orders. The Government answer in question 18 of the CRM indicates that OCI determinations should be fact specific but the clause as written does not recognize the definitions in FAR 9.5 regarding the type of work that creates an OCI vs work where the supplier has overall contractual responsibility for the development, the integration, assembly and checkout (IAC) or the production of the system that is being delivered.
The Government will not revise this clause.
HQ L-2-0005 NOTIFICATION OF POTENTIAL
ORGANIZATIONAL CONFLICT(S) OF INTEREST
(NAVSEA) (JUN 1994)
Is this clause only applicable to companies that provide support to NUWCDIVNPT, in the form of support of operation of the office or any of its programs? Please provide clarification regarding the scope of work that meet is in support of operation of the office or any of its programs.
This clause is not only applicable to companies that provide support to NUWCDIVNPT; these contractual arrangements are of primary concern.
L34X TECHNICAL PROPOSAL - COMPLEX ITEM
(FEB 2012); Page 1; 1.0 INSTRUCTIONS FOR SUBMISSION OF PROPOSALS; 1.2 Submission Requirements; (c) Cost/Price Proposal
L34X Technical Proposal – Complex Item (FEB 2012), 1.2(c), page 1 requires 3 hard copies and 5 electronic copies of the Cost/Price Proposal. However, Volume V was removed from the outline. Can the government please confirm that Section V is not required and that there is no required submission of a Cost/ Price Proposal?
Completion of clause H.2 satisfies the requirements for a Cost/Price proposal.
Volume V is eliminated; Offerors shall complete clause H.2 in accordance with Section L and submit as an Enclosure to the Cover Letter.
Are we to submit the filled in solicitation, B through K with the cost volume? It seems to contradict the instructions for Factor 5 in L34X.
The SF 33, and all clauses for Offeror completion shall be submitted as Enclosures to the Cover Letter. See also response above re: Volume V.
Comment Resolution Matrix_28 August 2017
Request is made for clarification/confirmation of the Government’s instructions with respect to the completion of pricing in Section B of the RFP. In Amendment 0001 a response to an additional question is provided which confirms that the total prices to be cited by Offerors in Section B should equal those provided in Section L. However, the response also infers that Offerors shall provide the Cost and Fee breakouts proposed for these line item totals. Conversely, in response to Q31 (page 19 of 23) of the Comment Resolution Matrix_Rev B, published on 16 Aug, the Government’s response indicated that it was requesting Offerors carry only the total amount from Section L into the pricing for Section B. The response provided in the CRM appears to be in concert with the instructions related to the H.2 Maximum Rates response in which Offerors are required to identify the maximum Fee Rate that will be proposed for individual orders and the understanding that Fee will ultimately be determined at the task order level. Please clarify/confirm the instructions to Offerors so that compliant proposals may be submitted as they pertain to this instruction.
The amounts included in Section L are totals, e.g., CLIN 0001
Cost: - Fee: - Total: $289,750,000
Does HQ C-2-0009, Assignment of Serial Numbers, only apply to deliverable hardware?
Yes; this clause only applies to deliverable hardware.
HQ E-2-0003 Calibration System Requirements states that the calibration of measuring and testing equipment shall, as a minimum, adhere to the requirements of ANSI/NCSL Z540.3-2006. Are alternative certifications acceptable, such as ANSI/NCSL Z540.1 or ISO 17025?
Alternative certifications that meet or exceed the requirements of ANSI/NCSL Z540.3-2006 are acceptable.

Can the government confirm if a cost volume/cost-price proposal is required or not? If one is required, what is the required data and the required format?
Note: Section L specifically states: “Offerors shall not submit data beyond that required by these instructions.”
Please see above responses re:
Cost/Price proposal and Volume V.
How does the Government want the SF 33 CLINS populated if not based on the “hypothetical tasks?” Can the Government provide clarification/guidance for cost/price proposal/Vol V/Factor 5?
Please see above responses re:
Cost/Price proposal and Volume V.
L34X Page: 7 Section/Paragraph: 3.1.1 Factor 1 – Hypothetical Tasks
In the Energy Storage/Conversion functional area identified in the L34X Tech Proposal M32X Eval for Award, each energy section shall have no less than 14kW (Threshold) of power at the above specified bus voltage, with a desired power of 28kW (Objective) at the above specified bus voltage. THESE ARE SPECIFIC OBJECTIVE AND THESHOLD VALUES. Power (kW) and Energy (kWh) are very different requirements and electro-chemistries. To describe the steps required to develop a concept (SOW 4.1), prototype design (SOW 4.2), prototype installation (SOW 4.3), test and evaluation (SOW 4.4), demonstration (SOW 4.5), logistics and maintenance (SOW 4.6), and transition to production (SOW 4.7), what are the SPECIFIC OBJECTIVE AND THESHOLD VALUES energy values (kWh), for each energy section?
The Government responded to all submitted questions regarding Hypothetical Task(s) in the Comment Resolution Matrix, posted to FedBizOpps 8 August 2017. It is included here for Offeror awareness:
The hypothetical tasks are intended to be broad to allow for a diversity of offerors to propose. Please list any assumptions made which were required to estimate complexity, material and labor hours. Please do not submit Classified information.
Clause H.2, paragraph A
Maximum Pass Through Rates
Does the maximum pass-through rate only apply when subcontracting more than 70% of the effort as defined in FAR 52.215-22 and 52.215- 23?
No. That interpretation is incorrect.
