Other Supplies or Services Will Satisfy Agency Requirements .

s. Rationale Justi_!Y.ing Use of Cited Statutory Authori~

Panavision Federal Systems developed the Modular Photonics Mast (MPM) under N0001410C0246, a competitively awarded contract by the Office of Naval Research (ONR) as part of the Affordable Modular Panoramic Photonics Mast (AMPPM;

future naval capability program. The mast is a "one of" technology proof of concept PEO- SUB (PMS435 ) has tasked NUWC to plan and execute design modifications to this mast , integrate and test the mast with several submarine subsystems , and install the mast on a Virginia class submarine . The results from these tests and instal l ation will feed the requirements and architecture for the competitive Virginia block V and Ohio Replacement Imaging Mast contracts.

While the ONR c ontract provides the Government with data rights to the design, ONR did not purchase a technical data package. Panavision Federal Systems (PFS) is the original equipment manufacturer (OEM) for this imaging mast

NCH 53 . 6 -2 (MAR 2013l

A survey of historical requests for quote on the Photonics Mast program yielded a cost of a technical data package for a system of this magnitude would be on the order of for inboard and outboard components with a delivery time of 1.5 years. PMS435 has tasked Code 34 to ready the mast for an FY18 installation date for one of several possible TI-16 Virginia class modernization availabilies (an availabilies are opportunities when the mast could be installed on a suitable Submarine) . Development of modifications for the mast and subsequent integration and testing are estimated to take two years

The time to deliver is prohibitive given the requirement for an FY18 installation date. In addition, the cost of the technical data package is quite high relative to the planned scope of the contract - it is unlikely that this cost would be recovered through competition.

Addition of a request for the technical data package suitable for a competitive contract would sufficiently add to the timeline of the program resulting in an inability to meet the FY18 installation date. This would impact the need of the fleet to conduct an operational assessment of the new technology prior to the planned competitive contract for Block V Virginia and Ohio Replacement (described in more detail in section 8).

6. Description of Efforts Made to Solicit Offers from as Many Of ferors as Practicable

In accordance with FAR 5.203(a), this action will be synopsized in FedBizOpps as a Sole Source requirement. Any challenges to this sole source action will be brought to the attention of the Competition Advocate and J&A Approval Authority prior to contract award

NCH 53 . 6-2 (MAR 2013 1

7. Determination of Fair and Reasonable Costs

In accordance with FAR 15.404(c) {l), cost analysis of the contractor's proposal will be conducted to ensure that the final agreed-to price is fair and reasonable.

8. Actions to Remove Barriers to Competition

PMS435 will be planning a competitive contract for the imaging masts for Block V Virginia Class and Ohio Replacement. This contracting action is estimated to be in FY19. Results from evaluation and testing of the Modular Photonics Mast will feed the architecture and requirements for this competitive contract. It is possible that some components or interfaces from the Modular Photonics Mast will be used in this contract. To prepare for the possibility of this requirement, the statement of work for the sole source contract will include language to purchase drawings, technical documentation, and source code. In the event that technology from the Modular Photonics Mast is carried into this competitive contract, the technical documentation procured will insure the removal of future barriers to competition related to the Modular Photonics Mast
