JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

(FAR 16.505)

1. Contracting Activity

The Naval Sea Systems Command, Naval Undersea Warfare Center Division Newport (NUWCDIVNPT), Contracts Department, Code 02, Newport, RI.

2. Nature and/or Description of Action Being Approved

This new task order is a complete follow-on to task order N66604-10-D-034A-0008 dated 7/30/13 with Electric Boat (EB) Corporation. Task order N66604-10-D-034A-0008 was previously competed in September 2012 and EB was the only responsive bidder.

3. Description of Supplies/Services (including the estimated value)

Estimated Dollar Value Funds Type Estimate

DWCF $895,112

As a specific need is identified and tasked via Technical Instruction and GFI, the contractor shall provide diagnostic testing and evaluation services to repair the following failed fleet components:

Environmental Monitoring Sensors (EMS), Circuit Card Assemblies (CCA), Circuit Board Assembly (CBA), Missile Tube Penetrators (MTP), and Differential Pressure Transducers (DPTs) in accordance with Applicable Documentation. At the conclusion of the testing, the contractor shall report the results and estimated repair cost for each unit to the Government. Upon written approval from the Government, the contractor shall execute the approved repairs. Period of Performance is 26 SEP 2014 through 25 SEP 2015.

4. Identification of the Exception to Fair Opportunity

This new task order is a complete follow-on to task order N66604-10-D-034A-0008 dated 7/30/13 with Electric Boat (EB) Corporation. Task order N66604-10-D-034A-0008 was previously competed in March 2013 and EB was the only responsive bidder. Huntington Ingalls declined to quote because they did not have significant experience in the area of system engineering and technical services in support of Attack Launcher Systems. Oceaneering also declined to quote stated they do not have the capability to perform the testing and analysis of the circuit cards nor the necessary qualifications to enter the VLS or MSL control panels.

Per FAR 16.505(b)(2)(i)(C) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

5. Supporting Rationale

EB is the Design Agent and In-Service Engineering Activity (ISEA) for the Tube Control Panel (TCP) and the Missile Tube Control Panel (MTCP) and as such has intricate knowledge of the TCP, MTCP and all the parts associated including the: Circuit Card Assemblies (CCA), Environmental Monitoring Sensors (EMS), Circuit Board Assemblies (CBA), Missile Tube Penetrators (MTP) and Differential Pressure Transducers (DPT’s). Task Order (TO) N66604-10- D-034A-0008 was initiated to troubleshoot and repair the associated parts. As stated above all awardees were given fair opportunity to be considered for awarded; however, EB was the only responsive bidder.

Task Order N66604-10-D-034A-0011 is the continuation of the same services to repairs of the same parts. The Statement of Work (SOW) tasking and scope is identical to the previously awarded task order.

6. Determination of Fair and Reasonable Costs

The contracting officer has made a determination of fair and reasonable pricing for this order using the proposal analysis techniques at 15.404-1.

7. Other Supporting Facts

Per Clause H41 (g)(3) "Ordering Under a Multiple Award Contract (FEB 2004)” this new request (TO 0011) falls under the logical follow-on exception to competition and award can be made directly to EB.

“H41 (g)(3) In the interest of economy and efficiency, as a logical follow-on phase of an order already issued under the contract, all awardees were given a fair opportunity to be considered for the original order.”

8. Actions to Remove Barriers to Competition

The ordering period for N66604-10-D-034 ends on 04-AUG-2015. As such, no further task orders under this contract are anticipated for these services. Actions to remove barriers to competition will be taken during the planning phase of the follow-on contract.
