About this file

This is a pre-solicitation synopsis for a multiple-award Blanket Purchase Agreement (BPA) for NetApp commercial hardware, software licenses, maintenance, and services to support Department of the Navy (DON) information technology networks and systems.

NIWC Pacific intends to establish the BPA pursuant to FAR 16.507-2 through the NASA Solutions for Enterprise-Wide Procurement (SEWP) VI Government Wide Acquisition Contract (GWAC). The resulting Enterprise Software License (ESL) agreement will support 17 Budget Submittal Offices across the DON and be available for decentralized ordering to all DON organizations. The BPA will have a five-year ordering period, with individual call orders capable of extending up to 60 months beyond the BPA expiration date if awarded prior to the ordering period end. The acquisition is not eligible for small business set-aside based on NAICS code 518210 (Computing Infrastructure Providers, Data Processing Web Hosting, and Related Services) with a $40M size standard, as no class waiver has been issued for the non-manufacturer rule. The primary Product Service Code is 7K20 (IT and Telecom - Storage Products), though additional PSCs may apply at the order level based on product and price list offerings. The anticipated NetApp ESL agreement will include a single master end-user license agreement, minimum discounts from NetApp's Federal Price Lists, and not-to-exceed limitations on year-over-year percentage increases for software and software renewal costs. The BPA will consolidate IT products, licenses, maintenance, and services under a negotiated ordering agreement to streamline procurement procedures, increase visibility of requirements, and achieve cost avoidance across DON operations worldwide. Interested parties should note this is market research only; the Government is not currently seeking proposals and will not accept unsolicited proposals, provide feedback, or reimburse response costs. Points of contact are Misty Weinhold (Misty.l.weinhold.civ@us.navy.mil) and Jerome Abaya (Jerome.d.abaya.civ@us.navy.mil).

This is a synopsis for NetApp commercial hardware, software licenses, maintenance, and commercial services to support its large and complex Information Technology (IT) networks, systems and workloads prepared in accordance with the format in Revolutionary Federal

Acquisition Regulation (FAR) Overhaul (RFO) Subpart 5.101. This announcement constitutes a pre-solicitation notice only.

DISCLAIMER: THIS IS A PRE-SOLICITATION SYNOPSIS ONLY. This synopsis is solely for planning and information purposes only and is not to be construed as a commitment by the Government to issue a subsequent solicitation (Request for Proposal, Request for Quote, etc.). This synopsis does not commit the Government to contract for any supply or service.

NIWC PAC is not seeking proposals at this time. Further, NIWC PAC will not accept unsolicited proposals in response to this synopsis and will not provide feedback or evaluation of the responses submitted. Participants in this market research are advised that the Government will not pay any costs incurred in response to this synopsis. All costs associated with responding to this synopsis will be solely at the interested party’s expense.

The North American Industry Classification System (NAICS) code applicable to this acquisition is 518210 “Computing Infrastructure Providers, Data Processing Web Hosting, and Related

Services” with a size standard of $40M. The Small Business Administration (SBA) has not issued a class waiver to the non-manufacturer rule for this NAICS. Therefore, in accordance with

FAR 19.108-8 and DFARS (DEV 2026-O0037), Limitations on subcontracting and the nonmanufacturer rule, the proposed acquisition is not eligible to be set aside for small businesses.

The Product Service Code (PSC) for this requirement is 7K20 IT And Telecom - Storage

Products (Hardware and Perpetual License Software), which aligns with the Category

Management Spend Categories IT: Application: Product and an Object Class Code of 31.0

Equipment. The description of this PSC includes hardware, software, and other equipment needed for specialized High-Performance Computing (HPC) systems used in solving complex computational problems through concurrent use of computing resources and parallel processing techniques. This PSC code is appropriate based on NetApp’s customary commercial practices and business model, under which their software and services are generally incidental to their hardware offerings and augment the storage management capability.

Due to the wide range of products and services that will be available under the BPAs, the appropriate PSCs are demonstrated in the product and price list which may result in a different

PSC code being determined at the order level.

Naval Information Warfare Center (NIWC) Pacific (PAC) intends to establish a multiple-award

Blanket Purchase Agreement (BPA) pursuant to FAR 16.507-2 (DFARS DEV 2026-O0045), Fair Opportunity Procedures, and the National Aeronautical and Space Administration (NASA)

Solutions for Enterprise-Wide Procurement (SEWP) VI Government Wide Acquisition Contract

(GWAC). The resulting Enterprise Software License (ESL) agreement will support 17 Budget

Submittal Offices (BSOs) across the DON. These BPAs will be available for decentralized ordering to all DON organizations. The term of the proposed BPA will consist of a five-year ordering period. BPA call orders (orders), including all options, can extend beyond the BPA ordering period by up to 60 months, provided they are awarded prior to the BPA ordering period expiration date.

The overall goal of a DON ESL agreement is to consolidate IT products, licenses, maintenance, and services under a negotiated ordering agreement where overall requirements can be tracked with greater visibility, ordering procedures can be streamlined, and cost avoidance can be achieved. This agreement will support DON operations worldwide and assist the DON in meeting IT asset management and IT category management requirements set out by the Office of

Management and Budget (OMB).

The anticipated NetApp ESL agreement will include a single, master end-user license agreement for all products and services ordered, thus providing benefits that individual DON users would not be able to achieve on their own. The agreement will include minimum discounts for each product line from NetApp’s Federal Price Lists and not-to-exceed limitations on year-over-year percentage increases on software and software renewal costs. In addition, it will allow agencies to establish agency-specific enterprise agreements benefiting from a more streamlined acquisition process.

An Acquisition Decision Memorandum and the Defense Acquisition Board are not applicable to this acquisition because this requirement is not in support of a Major Defense Acquisition

Program (MDAP) or Major Automated Information System.
