JUSTIFICATION FOR NON-COMPETITIVE PROCUREMENT

1 Template vJan2017

JUSTIFICATION FOR NON-COMPETITIVE PROCUREMENT (JNCP)

FOR ACTIONS BELOW THE SIMPLIFIED ACQUISTION THRESHOLD ($150,000)

PR/Solicitation Number: TBD Code: 52360

1) Agency, Contracting Activity and Purpose: SPAWAR Systems Center, Pacific, Code 22220, Justification for Other than Full and Open Competition.

2) Description of the Supply or Service being procured, its intended use and anticipated/estimated value (Answer the Following Questions):

a. Describe the product or service you want purchased (provide make, model, and product serial number/part number—include a spreadsheet if necessary)

MMC CONFIGURATION GPNTS MGU A1, Part No - 033010008, QTY 2 The first action will be to upgrade a MMC Configuration GPNTS SDU purchased under N66001-18-P-6832 to a MMC Configuration GPNTS MGU. The second action is to purchase a MMC Configuration GPNTS MGU.

b. What is its intended use or purpose?

The Modular Master Clock (MMC) Master Generator Unit (MGU) (GPNTS Configuration A-1) is identified in the Government approved GPNTS baseline and are required for compatibility with the GPNTS system software. The MMC MGU (GPNTS Configuration A-1) is used exclusively in the development and implementation of GPNTS system capability. If another manufacturer’s products were procured, the GPNTS software will fail to operate properly, which would prevent SSC Pacific Code 523 from completing the integration of MGUE into the baseline GPNTS. They are needed for GPNTS to communicate with external systems in accordance with defined interface specifications.

The baseline GPNTS system, being developed by PEO C4I PMW/A 170, incorporates current generation Selective Availability Anti-Spoofing Module (SAASM) GPS receivers. The Air Force GPS Directorate is the lead agency developing Military GPS User Equipment (MGUE), which are the next generation GPS receivers capable of receiving new signals in space (e.g. M-Code). They are required to develop and test MGUE on a lead platform for each domain. As the Maritime Domain lead, the Navy has designated that MGUE be integrated into GPNTS.

c. What is the total estimated cost of this/these products or services?

Upgrade cost is New unit cost is . Total cost is $51,480

3) Possible Authority for Non-Competitive Procurement (If you check block 3a.

below, complete associated table marked 3(a). If you check block 3(b) below, complete associated table marked 3(b).:

a. Sole/Limited Source Procurement (Only One Responsible/Capable Source) Is there only one responsible/capable source that can provide the supply or service? Non-competitive procedures can typically only be used when there is one source able to meet the Government’s minimum requirements (i.e., the manufacturer is the sole distributor/reseller of the product or service). If only one source can meet the Government’s requirements, complete table 3(a) below and provide a complete and thorough discussion of how you are aware that only one source exists in paragraph 4 below.

The MMC MGU has been in use by GPNTS since 2013; millions of dollars have been spent programming and testing the baseline GPNTS performance. If another manufacture’s product is purchased, the GPNTS baseline software would need to be reprogrammed and retested at a great expense to the government, somewhere between $0.5 million and $2.0 million. The delay required to reprogram and retest the use of another vendor product would prevent SSC Pacific Code 523 from completing any testing in a timely manner.

b. Brand Name Requirement (Item Peculiar to One Manufacturer) Is the requirement peculiar to a single brand name or one manufacturer? Competition can be limited to companies that are capable of providing the specific brand name, product or feature required when it is essential to purchase a specific brand because it is the ONLY brand that has the ability to meet the Government’s minimum requirements (i.e., while there is one manufacturer, multiple distributors/resellers exist for the product or service). If so complete Table 3(b) below.

TABLES – Complete the Table which corresponds to the answer you provided above.

TABLE 3(a) – ONLY ONE RESPONSIBLE/CAPABLE SOURCE (Item or Service can ONLY be procured from One Source/Company/Contractor and NO other source.)

No.

List the critical characteristics or capabilities necessary to meet the “Government’s Minimum Requirements”

What makes these critical characteristics/ specifications/ capabilities unique to this product/service and vendor?

Why is each identified critical characteristic required?

State any alternatives available or considered” as a means of fulfilling this requirement and why they aren’t viable; and what would be the impact if a product was purchased from another vendor or without each characteristic listed.

Brandywine MMC MGU (GPNTS Configuration A-1) is a required component of the GPNTS baseline that is currently used. It has already been identified in the Government approved GPNTS baseline and is required for compatibility with the GPNTS

The Navy has spent millions of dollars programming and testing GPNTS system performance.

No known substitute products exists. If a substitute product existed and is purchased, new drivers, software and cabling would be required. The cost to reprogram and re-test GPNTS is

The GPNTS system will be impacted which would prevent SPAWAR Code 523 from completing the MGUE integration into GPNTS.

estimated to be between $0.5 million to $2.0 million.

TABLE 3(b) – BRAND NAME REQUIREMENT (Item or Service MUST be a specific brand, make, or model; however, it may be purchased from multiple vendors.)

No.

List the critical characteristics or capabilities necessary to meet the “Government’s Minimum Requirements”; specific attribute(s) of this product not available in similar products

What makes these critical characteristics/ specifications/ capabilities unique to specific Brand/Manufacturer? Why is each identified critical characteristic required?

What is the impact if a similar/nearly equal product produced by another manufacturer were procured?

4) Describe the Market Research conducted.

You must provide sufficient narrative explaining your research, date performed, and how you are certain no other products exist that meet your requirements, or how you are certain that similar products are inadequate that meet your requirement. Market research is not a substitute for competition and requirements should be well-established prior to seeking use of non-competitive procedures. If your requirement is supported by an official document (e.g. a Program of Record) that mandates specific Brand Name materials that cannot be substituted, you must reference the document in sufficient detail to allow the reviewer to obtain the document; your notation must identify any applicable document number, date, paragraph/table or other identifying location, the issuing and approving authority. Attaching a copy of the applicable document provides the best support, and if the document is lengthy, provide copies of the applicable pages reflective of the mandated items, the title page (or equivalent), and approval page. In addition, you must explain the impact of using an “alternate or equal” item, in order to justify why market research was not conducted.

Use the table below (or attach a similar table) to supplement your narrative. Provide a comparison of your required item to any similar products or services that do not meet all of the criteria listed in table 3(a) or 3(b) above. If the product/service is truly unique and no other similar items exist, list only your product/service and check each box showing that it meets all minimum criteria listed in table 3(a) or 3(b). In the first row you will list each of your Critical Attributes/Minimum Characteristics from the Table in 3(a)/(b) above. Then, in the first column you will list each company/manufacturer and the brand/model of the product you reviewed. Finally, in the columns adjacent to the company/brand listed, you will indicate whether it “Met” or “Did Not Meet” the required characteristic. DO NOT LEAVE TABLE 4 BLANK.

The market research has been conducted by the GPNTS Program Office (PMW/A 170) and the contractor (Raytheon). The Brandywine product was selected at the GPNTS Critical Design Review (CDR) in 2013. They meet the technical requirements specified in the Government

GPNTS Technical Requirements Document (TRD).

5) List any other information or facts supporting the justification to limit competition not described elsewhere on this form.

If you do not have any additional information to add, simply write “N/A.”

N/A

6) Provide a statement of actions that will be taken to remove or overcome any barriers to competition prior to any future procurements for this Supply or Service (there is an ongoing duty to remove the elements of a justification that unduly restrict competition thereby allowing for competition of this requirement in the future).

Code 523 will continue to monitor any new product and price changes.
