JUSTIFICATION for an EXCEPTION to FAIR OPPORTUNITY for the placement of an order >SAT under a Multiple Award Contract (MAC)
Upon the basis of the following justification, I, Jorge Rosario, as Contracting Officer of SPAWARSYSCEN, Pacific, hereby approve the Justification for an Exception to Fair Opportunity Pursuant to FAR 16.505(b)(2).
JUSTIFICATION
l. Agency and Contracting Activity. Department of the Navy, SPAWARSYSCEN, Pacific.
2. Nature/Description of Action. This a fair opportunity exception to place an order with Booz Allen Hamilton (BAH) under multiple award contract number N66001-17-D-0156. The task order number is to be determined at award.
3. Description of Supplies/Services. This task order provides engineering services in support of the Fourth Generation Long Term Evolution (4gLTE) Communications Project including systems engineering, test development, and test execution support. The estimated value is $643,047.78.
4. Identification of the Exception to Fair Opportunity. (FAR 16.505 (b)(2))
Identification/Justification for Exception:
a. The agency need for services is of such urgency that providing fair opportunity would result in unacceptable delays.
b. Only one such awardee is capable of providing such services required at the level of quality required because the services ordered are unique or highly specialized.
c. The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the MAC, provided that all the awardees were given fair opportunity to be considered for the original order.
1. This is a logical follow on to task order N6600118F0549 issued on 10 April 2018. The reference task order was solicited via RFP 0020 to the following three (3) MAC holders under the Net-Centric C4ISR Shore Platform Integration and Systems Engineering MAC: BAH (Large Business), Solute (Small Business), and Geocent, LLC. (Small Business). Per the RFP instruction to offerors, MAC holders were instructed to submit a bid/no-bid decision on the work contemplated under the RFP’s Statement of Work. The RFP further stated that following receipt of the bid/no-bid notifications from all MAC holders, the Government would determine whether to set-aside the referenced requirement for the small business MAC holders. Both small business MAC holders subsequently submitted their decisions to no-bid the action on the basis of their inability to meet the technical requirements. BAH submitted its decision to bid.
2. The scope of the subject requirement is a continuation of work under the predecessor task order which builds upon software and hardware system design and testing efforts conducted with the purposes of developing specifications for the US Army to be able to specify the requirements for similar systems as a major program acquisition with full industry competition. As required by the predecessor order, the subject tasking requires that the contractor: (1) fluently understand the specification, analysis, design, acquisition development, integration, test, and evaluation of 4gLTE communications systems in a tactical environment; (2) integrate command and control and sensor systems with the 4gLTE system; and (3) develop and make adjustments to automated test data collection and/or analysis software systems used to test communications equipment.
3. In addition to its successful performance under the predecessor order, BAH was instrumental in planning and executing test at the in FY2018 from which several lessons learned from the first round of testing were directly fed into a second set of tests performed. The subject effort seeks to capitalizes on lessons learned from work and experience gained from working in under an austere test environment
4.
of the subject task order. Due to the fact that the program is still in the development phase, the risk associated with the transfer of complex testing to a new offeror while still under development could result in damage to high value systems, and present an undue risk to project execution at this point in the project development cycle. As such, the nature of this requirement and the accelerated project schedule requirements compel the Government to rely on the availability of BAH who already have the necessary knowledge and experience with this communications technology. The Government’s risks regarding cost, schedule and performance are substantially diminished by this follow-on action due to BAH’s successful performance of the predecessor order.
d. It is necessary to place an order to satisfy a minimum guarantee.
e. For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.
5. Determination of Fair and Reasonable Cost. Based on the historic cost information currently available, the Contracting Officer has adequate information to ensure that the cost to the government for this acquisition will be fair and reasonable.
6. Any Other Facts Supporting the Justification. N/A.
7. Actions Taken to Remove or Overcome Barriers that Led to the Exception to Fair Opportunity. The software and hardware system design and testing efforts being conducted under this task, will lead to the development of specifications for the US Army to utilize in the development of the requirements for similar systems in a major program acquisition. Once finalized, these requirements will be used to provide for competition in a full and open environment.
