EXCEPTION to FAffi OPPORTUNITY for the placement of an order >$150K nnder a Multiple Award Contract (MAC)

Upon the basis of the followingjustification, I, Sharon Pritchard, as Competition Advocate of SPAW ARSYSCEN, Pacific, hereby approve the Exception to Fair Opportunity Pursuant to FAR 16.505(b)(2).

JUSTIFICATION

l. Agency and Contracting Activitv. Department of the Navy, SPAW ARSYSCEN, Pacific.

2. Nature/Description of Action. This is a fair opportunity exception for ConcutTent Technologies Corporation (CTC) under multiple award contract number N6600 l-13-D-0073.

The estimated award date of proposed order is 25 June 2018.

3. Description of Supplies/Services. This will be a level-of-effort (LOE) order providing technical management and analytical support to Sexual Harassment, Hazing and Other Problematic Behavior Data collection and analysis, reporting, maintenance, and assessment for the Under Secretary of Defense for Personnel and Readiness, USD (P&R), Office of Diversity of Management and Equal Opportunity (OD MEO). This Task Order will support the elimination or reduction of the technical and analytical challenges associated with the collection of problematic behavior data from multiple sources with various formats. Accomplishing this goal will facilitate an increase in DoD operational readiness by ensuring OD MEO has accurate and timely data on key military readiness and safety issues satisfying the requirements of the National Defense Authorization Act (NDAA) of2017 and meeting the Congressional reporting goals.

The estimated value of the one-year effort (no options) is$ l .72M.

Estimated Dollar Value

Funds FY18 Total O&M $1.72M $1.72M

4. Identification of the Exception to Fair Opportunity. (FAR 16.505(b)(2)(i)(B))

Identification/Justification for Exception:

D a. The agency need for services is of such urgency that providing fair opportunity would result in unacceptable delays.

12-?] b. Only one such awardee is capable of providing such services required at the level of quality required because the services ordered are unique or highly specialized.

CTC has been the sole contractor supporting technical management, and analytical support to the "Readiness Safety Systems (RSS) Sexual Harassment, Hazing and Other Problematic Behavior Data Collection and Reporting" on the Defense Readiness Reporting System - Strategic (DRRS S) Multiple Award Contract (MAC). Under SSC Pacific Task Order N66001-l 7-F-0742, all

DRRS-S MAC awardees were provided fair opportunity to compete. CTC was the only contractor that provided a response to the Task Order RFP in May 2017.

This requirement will leverage the detailed data analysis and lessons learned conducted by CTC on N6600 l-17-F-0742 and turn them into the requirements specifications necessary to solve the technical and analytical challenges associated with the collection of data from multiple sources with various formats. Alternatives for satisfying the requirements will be analyzed and Courses of Actions (COAs) will be developed. Resultant solution(s) and operational prototype(s) will be demonstrated to leadership so that an informed decision can be made regarding the suitability and affordability of technology that supports the delivery of accurate and timely key military readiness and safety data to Congress.

CTC is the only awardee capable of providing these particular services at this time. In FY2016, CTC supported ODMEO and P&R in a successful pilot demonstration using the Force Risk and Resiliency (FR2) data warehouse to receive, process, map, and aggregate sexual harassment data from the Navy, Marine Corps, and Army and generate FR2 dashboards displaying data provided from each source. CTC continues to support OD EMO, P&R and all the Services through the processing, integration, implementation, testing, documentation, and training for the Sexual Harassment, Hazing, and Bullying data in the Problematic Behavior portal in FR2. The requirement to collect and repott this data to congress was formalized in the National Defense Authorization Act (NDAA) of2017.

With CTC's support, the pilot and the subsequent repo1ting to Congress in FYl 7 and FY18 have been successful; however, the level of effo1t required for each service and ODMEO to provide accurate and timely data to suppott DO D's readiness reporting requirements remains critical.

The goal of this effott is to document and demonstrate solutions that provide the services with a methodology that suppotts standardized, accurate input of sexual harassment, hazing, and other problematic behavior data.

At this time, competing the requirement among all DRRS-S contract awardees would not promote program or cost efficiencies and would add significant risk. The funding for this initiative was resourced from the FYl 8 budget. No other funding will be available in the out years to support this requirement. If the task is competed, the funds for solving the technical and analytical problems associated with the collection of data from multiple sources with various formats could be exhausted to support a possible transition.

Historically, it takes approximately six (6) months to transition to a new contractor. The anticipated unprogrammed cost for the incumbent to support the transition is broken down below:

Description Calculation Cost

Cost for five .75 x months of Monthly

$537,500.00 turnover Cost x 5 support

Cost for last .50 x $71,600.00 month of Monthly turnover Cost x I support

Transition Support Cost

$609,100.00

Monthly cost based upon Government Independent Cost Estimate

The cost estimate above would only support transition of the operations and sustainment of the original work. Therefore, critical work necessary to solve the technical and analytical challenges associated with the collection of data from multiple sources with various formats would be put on hold until the transition is complete. Subsequently, the funding and time necessary to solve the issues are nearly cut in half and the opportunity for leadership to make an informed decision regarding the suitability and affordability of technology that supports the delivery of accurate and timely key military readiness and safety data to Congress would be lost. Subsequent congressional readiness reporting as directed by the NDAA of2017 would be jeopardized.

It is in the best interest of the Government to award this Task Order to CTC to solve the data collection problems using the detailed data analysis and lessons learned under N6600 l-l 7-F- 0742.

D c. The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued nuder the MAC, provided that all the awardees were given fair opportunity to be considered for the original order.

D d. It is necessary to place an order to satisfy a minimum guarantee.

De. For orders exceeding the simplified acquisition'threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

5. Determination of Fair and Reasonable Cost.

The contractor will submit a formal cost proposal with cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. CTC's proposal will be reviewed by the technical customer, the contract specialist, and the contracting officer. Field pricing assistance will be requested from the Defense Contract Audit Agency (DCAA) and the Defense Contract Management Agency (DCMA). The cost or pricing data will be certified by CTC at the conclusion of negotiations in accordance with FAR 15.403-4.

6. Any Other Facts Supporting the Justification.

None.

7. Actions Taken to Remove or Overcome Ban"iers that Led to the Exception to Fair Opp01tunity.

The ordering period for the DRRS-S MAC ends on 26 June 2018, so this will be the last task order issued under this MAC. It is anticipated that the next task order will be competed.
