NAVAL SURFACE WARFARE CENTER
CARDEROCK DIVISION
J&A Number: 0232-15-036-00 Code:
P.R. Number: 1300474570
LIMITED SOURCE JUSTIFICATION
This acquisition is being conducted under the authority of the Multiple Award Schedule Program (MAS) as authorized by Title III of the Federal Property and Administrative Services Act of 1949 (41U.S.C. 251, et seq.) and Title 40 U.S.C. 501, Services for Executive Agencies, as implemented at FAR Subpart 8.4.
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Carderock Division (NSWCCD) (Code ).
2. Description of Action Being Approved
This is a limited source action for placement of an order under a Federal Supply Schedule that restricts the consideration of schedule contractors to fewer than that required by FAR 8.405-1. This restriction is necessary because only one source is capable of providing the supplies required at the level of quality required because the supplies are unique and highly specialized. The proposed action is for a new Firm Fixed Price (FFP) contract to be awarded to Equipment Resource Center, Inc. 2104 Don Ave, Westminster, MD 21157 for a Coordinate Measuring Machine (CMM), including associated parts.
3. Description of Supplies/Services
The items being purchased are listed below and are being purchased under GSA Contract GS-06F- 0001N. These items consist of a Coordinate Measuring Machine, including all necessary operational components; the estimated value is $278,612.52.
FY 2015
The requested delivery date for these items per the approved execution plan is prior to 30 September 2015. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. Equipment required is as follows:
NAVAL SHIP SYSTEMS
ENGINEERING STATION
5001 S BROAD ST
PHILADELPHIA, PA 19112-1403

Exemption from the synopsis requirement for Coordinate Measuring Machine (CMM) falls under Federal Acquisition Regulation (FAR) Subpart 5.2 -- Synopses of Proposed Contract Actions, FAR 5.202(a)(11) which states the following:
(11) The proposed contract action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of 5.207 with respect to the current proposed contract action;
Additionally, FAR 8.404(a) states that:
8.404 – Use of Federal Supply Schedules.
(a) General. Parts 13 (except 13.303-2(c)(3)), 14, 15, and 19 (except for the requirement at 19.202-1(e)(1)(iii)) do not apply to BPAs or orders placed against Federal Supply Schedules contracts (but see 8.405-5). BPAs and orders placed against a MAS, using the procedures in this subpart, are considered to be issued using full and open competition (see 6.102(d)(3)). Therefore, when establishing a BPA (as authorized by 13.303-2(c)(3)), or placing orders under Federal Supply Schedule contracts using the procedures of 8.405, ordering activities shall not seek competition outside of the Federal Supply Schedules or synopsize the requirement; but see paragraph (g) of this section.
Based on the above, no additional market research will be conducted because it is not practicable for any company other than Equipment Resource Center, Inc. to provide the required supplies and services.
6. Determination of Best Value
The Contracting Officer has determined that the proposed order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
7. Market Research
Market research was conducted by Code 1026 and proved unsuccessful in finding sources capable of meeting the required capabilities specified by NSWCCD.
Multiple internet searches were conducted as well as a search of GSA Advantage and various sites showing past government contracts and purchases. Equipment Resource Center, Inc. was the only manufacturer that met the capability requirements.
8. Other Facts Supporting the Limited Source Justification
The Contracting Officer will determine whether the cost to the Government for the supplies/services covered by this Justification and Approval are fair and reasonable, prior to award.
9. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWCCD Code has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCCD Code will assess whether competition for future requirements is feasible.
