JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY T~
Sy;temsC1m/cr ATl..ANrlC
IN ACCORDANCE WITH THE FOLLOWING JUSTIFICATION, AS Contracting Officer, SPA WARSYSCEN Atlantic, , I HEREBY
APPROVE THE EXCEPTION TO FAIR OPPORTUNITY (FOE) PURSUANT TO FAR 16.505(b)(2)(i) (C) Logical Follow-On
CONTRACT NUMBER(S) I CRM RESERVATION# I TASK ORDER (TO) NUMBER(S) I ESTIMATED DOLLAR VALUE
N65236-14-D-4983 CRM-17-01923 0018 $18,000.00
1. AGENCY AND CONTRACTING ACTIVITY. Department of the Navy, Space and Naval Warfare Systems Center (SPAWARSYSCEN) Atlantic.
2. NATURE/DESCRIPTION OF ACTION(S).
This is a fair opportunity exception to place a non-competitive task order with Systems i\ .. pplications and Solutions (SAS) under a multiple award contract.
3. DESCRIPTION OF SUPPLIES/SERVICES.
A listing of major additional supplies/services required as scope increase is as follows:
I. hours labor Engineering Technician IV
2. hours labor Electronic Technician II
3. Wire, cable, conduit, stand off, boxes, and fasteners
4. IDENTIFICATION OF EXCEPTION TO FAIR OPPORTUNITY.
D (a) The agency's need for supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
O (b) Only one awardee is capable of providing the supplies or services at the level of quality required because the supplies or services ordered are unique or highly specialized.
IZJ (c) The order must be issued on a sole-source basis in the interest of economy and efficiency, because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
D (d) It is necessary to place an order to satisfy a minimum guarantee.
JUSTIFICATION:
Existing DO 0018 on this contract involves the engineering services to integrate new voice evacuation fire alarm systems installed under construction projects with the base-wide mass notification system operated by installation Physical Security Staff at multiple USMC CONUS installations.
A de-obligation of $10,000.00 is requested due to MILCON construction delays on Building 22164 at Camp Pendleton and Building P863 Hangar at Kanoehe Bay. Installation services cannot be provided at these 2 sites under this contract.
A scope increase of $28,000.00 has occurred as a result of government site approval delays at Camp Lejeune) NC and malfunctioning existing equipment at MCAS Miramar, CA Site approval delays led to additional contractor travel and labor costs at Camp Lejeune. Faulty existing equipment required additional travel and labor costs for task completion at MCAS Miramar.
DO 0018 Mod 3 will provide ceiling increase of$18,000.00 to account for $10,000.00 de-obligation and $28,000.00 scope increase.
Processing this through a new competitive bid process would involve additional time delays and loss of efficiency. Awarding DO 0018 Mod 3 to SAS on the N65236-14-D-4983 contract is a logical follow on since they are currently performing all work under the existing task order. The original order was openly competed on the Ashore Systen1s Engineering Multiple Award Contract. The ceiling increase represents a minimal risk for both the Contractor and the Government.
Knowledge of the cu1Tent work cannot be easily transferred to another contractor because SAS has developed extensive site knowledge during 10 months of contract execution involving multiple personnel at multiple sites. Extensive time would be required to bring another contractor in as they would need to conduct additional site surveys at each location. The time required for surveys can be estimated at roughly 80 man-hours at a cost of roughly $80,000. Processing this through a new competitive contract process would also involve additional time delays and increase the government's effo1t and administrative burden.
The major loss of efficiency would be in the coordination required between two separate contractors working at the same sites. The

FAIR OPPORTUNITY EXCEPTION
CONTRACT NUMBER(S) I CRM RESERVATION# I TASK ORDER (TO) NUMBER(S) I ESTIMATED DOLLAR VALUE N65236-l 4-D-4983 CRM-17-01923 0018 $18,000.00 work would have to be coordinated in order to avoid excessive downtime of security systems, and excessive wait periods would result for each contractor. If one or the other of the contractors completed work at a site, the systems could not fully function and be tested until the second contractor completed their work. Since both contractors do not have exact same proportions of work, this would definitely result in continual disruptions of work as one contractor waited on another to finish; then, a new site could not begin until both contractors had finished the prior site. This results in a very difficult bid situation for the contractors, and a difficult situation for the gove1nment to manage.
5. DETERMINATION OF FAIR AND REASONABLE COST.
The proposals will be analyzed in accordance \Vith FAR 15.404. It is anticipated that the government will use various cost/price analysis techniques, including but not limited to: (1) comparison of proposed prices to historical prices paid; (2) comparison of proposed prices with independent government cost estimate amounts; and (3) comparison of proposed prices obtained through market research for the same or similar items, such that the anticipated cost to the government will be fair and reasonable.
6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION.
None.
7. ACTIONS TAKEN TO REMOVE OR OVERCOME BARRIERS THAT LEAD TO THE EXCEPTION TO FAIR OPPORTUNITY.
SPA V./ ARSYSCEN Atlantic is continuously reviewing data on the industty and commercial products that provides similar products/ services. Should other acceptable sources become known that meet the Gove1nment's unique needs, appropriate action to ensure full and open competition will be taken. The solicitation that was used to a'¥ard the base contract was publicized on FedBizOpps and awarded on a competitive basis. Other than the situation desc1ibed herein, future orders under the multiple award contract will be competitive to the maximum extent possible.
