About this file

This amendment modifies a solicitation for the overhaul of LM2500 Power Turbine Assembly components. The Navy seeks these services to support marine gas turbine engines on various vessel classes. The amendment extends the response deadline to December 28, 2020 while providing answers to questions from prospective contractors. Services required include full overhauls with functional testing of Power Turbine Assemblies and their individual components. The Navy will furnish necessary technical manuals and accept testing using contractor-owned gas generator cores. Transportation of equipment remains the responsibility of the selected contractor.

SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

PART I

The solicitation closing date is hereby extended to 28 December 2020.

PART II

This amendment provides a list of questions and comments received in response to the solicitation. The questions and comments are provided for all potential Offerors to review. Note that questions may have been edited for clarity and duplicative questions may have been combined or deleted. All available, necessary information and any necessary changes to the solicitation resulting from consideration of the below questions and comments have been incorporated into the solicitation. As a result of this amendment the solicitation is considered to be clear.

1) Q: Section L.3.1.3 requires submittal of the “Completed RFP”, but goes on to state that “Offerors shall not submit a cost/price proposal at this time. CLINs 0001-0005 are a maximum quantity to be ordered throughout the life of the Contract(s).” Can you please clarify exactly what pricing elements, if any, are required for the due date of December 7, 2020?

A: No pricing is required for proposal submission.

2) Q: May the Contractor formally request issuance of the Navy Technical Manuals identified in section C.2.2 prior to contract award?

A: No, the Government will not be providing Technical Manuals prior to contract award as they contain proprietary information from the OEM. The US Navy LM2500 technical manuals will be provided after contract award to the successful Contractor(s) as Government Furnished Information (GFI), in accordance with Section 2.2 of the Statement of Work.

3) Q: In reference to section C.3.2, may the Contractor use a Contractor-owned LM2500 Gas Generator for functional testing of the overhauled Power Turbine Assemblies?

A: Acceptable relating to post-overhaul performance testing of US Navy LM2500 Power Turbine Assemblies.

4) Q: In reference to section C.3.2, where the test cell is not coupled to a generator or dynamometer, Contractor will install the overhauled Power Turbine Assembly onto a serviceable LM2500 Gas Generator and perform a functional check including seal break-ins. The Power Turbine Assembly will be taken through its entire speed range with no load applied, and full assessment will be conducted of rotation, vibration, starting, restarting and overspeed transducer output voltage in accordance with US Navy LM2500 depot level technical manual S9234-AB-MMD-040/LM2500 Chapter 22. Is this method of testing acceptable to NSWCPD?

A: Acceptable relating to post-overhaul performance testing of US Navy LM2500 Power Turbine Assemblies.

5) Q: At what point in the solicitation process will NSWCPD cease to receive and discuss clarifications from Contractors on the final contract terms?

A: The deadline for receipt of questions was 14 calendar days from the date that the RFP was issued (20 November 2020). Please refer to L-215-H007 for additional information. The question and answer submission for this RFP is now closed and further questions regarding the RFP will not be entertained.

6) Q: May Contractor request a comprehensive list, accompanied by the full text, of all clauses to be included in the final contract?

A: For a comprehensive list, accompanied by the full text, of all clauses to be included in the final contract, please refer to all clauses that are currently included in the RFP.

7) Q: Contractor requests confirmation from NSWCPD regarding indemnity provisions; will NSWCPD require indemnification from Contractors in the final contract document?

A: The RFP does not reference any indemnity provisions and therefore will not be included in a resultant contract.

8) Q: Will there be an overall Limitation of Liability cap on Contractor’s financial responsibility in the final contract documents? If so, will FAR 52.246-23 Limitation of Liability or FAR 52.246-25 Limitation of Liability-Services be applied? Will negotiation/further clarification on this matter be permitted?

A: FAR 52.246-23 and FAR 52.246-25 are not in the RFP and therefore will not be included in a resultant contract.

9) Q: Will NSWCPD include a waiver of indirect and Consequential losses in the final contract terms?

A: FAR 52.212-4 states the following: “Limitation of liability. Except as otherwise provided by an express warranty, the Contractor will not be liable to the Government for consequential damages resulting from any defect or deficiencies in accepted items.”

10) Q: It is understood by the Contractor per section C-246-H001 that Contractor’s standard commercial warranty will apply to all services rendered to the extent it does not conflict with other terms of the contract. Can NSWCPD please confirm which FAR clauses will be applicable to the final commercial warranty as negotiated between the parties?

A: Please refer to all of the clause(s) / provision(s) that are currently included in the RFP

11) Q: Contractor requests confirmation on who has responsibility for transportation of the Power Turbine Assemblies and on what delivery terms. Will NSWCPD consider using international Incoterms® 2010 for the delivery terms?

A: Transportation of the Power Turbine Assemblies will be the responsibility of the contractor in accordance with FOB Destination. NSWCPD will not implement other terms and conditions. Please refer to Section F, FAR 52.247-34, F-211-H021, and any other references in the current solicitation, when following procedures.

12) Q: If assistance is required when working with DoD SAFE, who should be contacted?

A: Please refer to the HELP portal found at https://safe.apps.mil.
