AMENDMENT 2
This amendment provides a list of questions and comments received in response to the solicitation. The questions and comments are provided for all potential Offerors to review. Note that questions may have been edited for clarity and duplicative questions may have been combined or deleted. All available, necessary information and any necessary changes to the solicitation resulting from consideration of the below questions and comments have been incorporated into the solicitation. As a result of this amendment, the solicitation is considered to be clear.
Question 1.
On page 120 Para L.2.3 it states: Emailed proposals are not permitted. ON page 125 in FAR 52.212-1 para 2 (i) A it states if transmitted through an electronic commerce it must be received not later than 5:00 PM one working day prior to the date specified for receipt. Can you confirm email submissions are acceptable or not.
Answer 1.
Emailed proposals are not permitted. The clause states “If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers.” This is NOT authorized by this solicitation.
Question 2.
What does the following clause mean by “all units of all items will be awarded to one offerer”? It appears to conflict with the multi award contract type. On page 132. M-215-H004 BASIS OF AWARD (NAVSEA) (DEC 2018)
Answer 2.
A multiple award contract is different from a split award contract. Under multiple award contract, all Offerors must have the capability of furnishing all units as specified in this solicitation. Clause M-215-H004 Basis of Award is a standard clause for all NAVSEA solicitations.
Question 3.
What “Warranty Tracking Information” is required in accordance with 252.246-7005 (b) 1?
252.246-7005 Notice of Warranty Tracking of Serialized Items (MAR 2016)
(a) Definitions. Duration, enterprise, enterprise identifier, fixed expiration, item type, serialized item, starting event, unique item identifier, usage, warranty administrator, warranty guarantor, and warranty tracking are defined in the clause at 252.246-7006, Warranty Tracking of Serialized Items.
(b) Reporting of data for warranty tracking and administration.
(1) The Offeror shall provide the information required by the attachment entitled “Warranty Tracking Information” on each contract line item number, subline item number, or exhibit line item number for warranted items with its offer. Information required in the warranty attachment for each warranted item shall include such information as duration, fixed expiration, item type, starting event, usage, warranty administrator enterprise identifier, and warranty guarantor enterprise identifier.
Answer 3.
Clauses 252.246-7005 and 252-246-7006 have been removed from the solicitation as a result of this amendment.
Question 4.
Where is Exhibit A and the forms CDRL No.s A001 to A008 and Attachment 2? Should they have been included with the solicitation form?
Answer 4.
Exhibits A001-A008, Attachment 1, and Attachment 2 were erroneously excluded from the RFP at issuance; they are now attached to the RFP as a result of this amendment. Attachment 3 will be provided, at the Awardee(s) request, after contract award.
Question 5.
What is the process for progress payments? On page 40 there is reference to progress payments but it is not clear when and how they can be requested.
DESTINATION/DESTINATION
(iii) For customary progress payments based on costs incurred, submit a progress payment request.
Answer 5.
Clause 52.204-13, Notice of Progress Payments is not included in the solicitation as these services are commercial and the clause is not applicable. The solicitation does not include provisions for contract financing or interim payments. Should an offeror request financing, it should consult FAR 32.202 and include the request with its proposal.
Question 6.
What is the specific “covered defense information” supplied with this contract? See clauses 252.204-7012 (page 57) and 252.204-7008 (page 88).
Answer 6.
Covered defense information to be supplied under this requirement includes but is not limited to, the US Navy LM2500 technical manual (See Section C, Para 2.2, Page 7 of the RFP).
Question 7.
DFAR 252.204-7004 Alt A System for Award Management Alt A does not appear to exist as it is presented on Page
57. Should it be FAR 52.204-7 System for Award Management?
Answer 7.
DFAR 252.204-7004 Alt A is replaced with clause 252.204-7007 Alt A, Annual Reps and Certs.
Question 8.
Does the following FAR (on pages 25 and 26) apply to foreign contractors operating outside of the USA?
C-237-H001 ENTERPRISE-WIDE CONTRACTOR MANPOWER REPORTING APPLICATION
(NAVSEA) (OCT 2018)
Answer 8.
Yes.
Question 9
Page 41, section G-216-H003 ORDERING PROCESS FOR MULTIPLE AWARD CONTRACTS - Does any action need to be taken on our part during the “Proposal” phase of the contract? In particular paragraph d) of the section ? Is the SeaPort Portal applicable to the contract?
Answer 9.
The ordering clause G-216-H003 is for Task Orders issued under the resulting MAC from this solicitation. It is applicable after contract award. The SeaPort portal may be utilized for competing Task Orders under this MAC.
Question 10.
Can proposals exceed the 10 page limit as stated in L.3?
Answer 10.
Page limit is 10 pages as stated in the RFP. This excludes cover letters and copies of commercial warranties submitted in accordance with C-212-W001 CONTRACT TERMS AND CONDITIONS—COMMERCIAL ITEMS ADDENDUM TO 52.212-4 on page 23 of the solicitation.
