JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
BRAND NAME JUSTIFICATION
This acquisition is conducted under the authority of the Multiple Award Schedule Program as authorized by Title III of the Federal Property and Administrative Services Act of 1949 (41
U.S.C. 251, et seq.) 40 U.S.C. 501, Services for Executive Agencies, as implemented at FAR
16.505(b)(2)(i)(B).
1. Contracting Activity
The contracting activity is the Naval Ship Systems Engineering Station, Naval Surface Warfare
Center, Philadelphia Division (NSWCPD), Code 0222, Philadelphia, PA.
2. Description of Action Being Approved
The resultant action will be a Firm-Fixed-Price (FFP) order for brand name items under the
National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide
Procurement (SEWP) program. The brand name action is confined to authorized resellers of
Dell computing equipment and peripherals.
Competition will be limited to NASA SEWP V sources for Dell. Based on the needs of
NSWCPD described in paragraph 4 below, we will solicit from NASA SEWP V sources that can provide Dell computing equipment and peripherals.

This equipment will be used to execute the research and development tasks performed by the
NSWCPD modeling and simulation lab, Code 30 distributed heterogeneous simulation lab, Microsoft Windows 10 computer hardware refresh, and cybersecurity lab. The total estimated cost of the Hardware including all its other costs on site system is .
Requirements described herein represent the Government’s minimum needs as verified by certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
The authority permitting other than full and open competition is FAR 16.505(b)(2)(i)(B), “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.”
5. Rationale Justifying Use of Cited Statutory Authority
This procurement is necessary to ensure support of the research and development initiatives of the NSWCPD modeling and simulation lab, Code 30 distributed heterogeneous simulation lab, Microsoft Windows 10 computer hardware refresh (Windows 10 requires TPM 2.0 compatibility required per DISA Microsoft Windows 10 image for data encryption), and cybersecurity lab.
Utilizing equipment from any brand other than Dell would present an issue with IT configuration management and interoperability when connecting to existing infrastructure, due to different specifications from manufacturer to manufacturer. Third party white box systems pose a security risk to underlying network(s) systems. We cannot validate that those third party computers contain hardware components and/or software that could be malicious to our network. The aforementioned hardware was chosen based on the following specifications:
P.R. Number: 1300581623
-Current computer racks have been purchase to support Dell T7910 workstations
-Dell T910 workstations have a removable front door allowing for easy access to change drives during testing
-Workstations are part of an approved list of equipment that can be installed on the network
-NSWCPD currently owns data acquisition equipment that has been configured to the max PCIe/PCI slots for the above referenced Dell equipment (mechanically and electrically compatible) which has been optimized to work with the requested workstations
-Allows for defective media retention, which complies with DOD regulations
NSWCPD is also trying to replicate existing systems in the fleet. The brand name provides for the same hardware that is already being used in fleet systems. NSWCPD needs the ability to test down to hardware such as network interface controllers and hard drive controllers identical to the fleet to support the mission.
After a competitive procurement process, NASA awarded multiple resellers a contract to supply
Dell computers and accessories under NASA SEWP V.
6. A determination by the Ordering Activity Contracting Officer that the Order Represents the
Best Value Consistent with FAR 5.404(d).
The Contracting Officer will determine whether the cost to the Government for the supplies/services covered by this Justification and Approval are fair and reasonable, prior to award.
7. Other Facts Supporting the Justification
IAW FAR 5.202(a)(6), this J&A will be posted along with the solicitation.
After adequate market research conducted by the technical branch, it was concluded that no other manufacturer’s equipment could replace the above referenced items to maintain functionality and interoperability. The components required to operate and manage the fleet systems network is owned and copyrighted by HP; no other source has access to the required information to be able to provide the required functionality.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 7, NSWCPD Code 0222 has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
