JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

BRAND NAME JUSTIFICATION

This acquisition is conducted under the authority of the Multiple Award Schedule Program as authorized by Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.) 40 U.S.C. 501, Services for Executive Agencies, as implemented at FAR 16.505(b)(2)(i)(B).

1. Contracting Activity The contracting activity is the Naval Surface Warfare Center, Philadelphia Division (NSWCPD), Code 0222.

2. Description of Action Being Approved This is a brand name action to be awarded without providing for full and open competition. The proposed contract action is to be limited to offerors that can provide Cisco Corporation networking equipment only. This procurement will be conducted under the NASA Solutions for Enterprise-Wide Procurement (SEWP) Government-Wide Acquisition Contract (GWAC) vehicle.

3. Description of Supplies/Services Required to Meet the Agency’s Needs This procurement is for hardware and software to implement a network Intrusion Detection/Prevention System (IDPS) as a part of NSWCPD’s existing Cisco networking and firewall architecture. The equipment being purchased is required to be able to fully interoperate seamlessly within the existing installed infrastructure. NSWCPD is required to have a fully operational network IDPS system in order to operate its Research Development Test & Evaluation (RDT&E) network. This requirement originates from the Defense Information Systems Agency (DISA) Security Technical Implementation Guides (STIGs). There is a requirement to be compliant with the DISA STIGs as part of maintaining the RDT&E network’s Authority To Operate (ATO). If NSWCPD’s RDT&E network loses its ATO, the network would be shut down and therefore remove a resource from NSWCPD’s scientists and engineers require in order to successfully perform their fleet support and RDT&E requirements. The subject requirement is for various chassis, line cards, and modules, with a total estimated cost of about $177,181.31, utilizing working capital funds. The list of equipment is as follows:

Item 0001, MSE license PAK for software code 8.0 (qty 1)

Item 0002,100 AP Base Location Services License (qty 1)

Item 0003,100 AP WIPS monitor mode licenses (qty 1) Item 0004, MSE virtual appliance (qty 1) Item 0005, Hyperlocation antenna, model 1 (qty 80)

Item 0006, 802.11ac Wave 2; 4x4:4SS (qty 20) Item 0007, 802.11ac controller AP 4x4:3SS w/ CleanAir, Exterior Antenna (qty 30) Item 0008, Low profile antenna (qty 120)

Item 0009, Hyperlocation module with advance security (qty 80) Item 0010, Cisco 5700 series wireless controller for up to 50 Aps (qty 1) Item 0011, Cisco 5700 series wireless controller for high availability (qty 1)

Item 0012, 802.11ac controller AP 4x4:3SS w/ CleanAir, Interior Antenna (qty 50)

4. Statutory Authority Permitting Other Than Full and Open Competition The authority permitting other than full and open competition is FAR 16.505(b)(2)(i)(B), “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.”

5. Rationale Justifying Use of Cited Statutory Authority This procurement is necessary to ensure data integrity for technical analyses performed by NSWCPD. The design of the storage system was performed by Cisco. Cisco provided specialized hardware and software to increase performance, reliability, and rapid recovery. They are therefore uniquely qualified to provide compatible spare parts. Due to these conditions, only maintenance as provided by the original hardware provider will satisfy this requirement.

Utilizing storage equipment from any brand other than Cisco would present a detriment in the command’s ability to ensure data integrity, because no other source has access to the required information to be able to provide the required functionality and interoperability. This brand allows the command to manage and maintain their storage equipment inventory due to flexibility and interchangeability.

After a competitive procurement process, NASA SEWP awarded multiple resellers a contract to supply Cisco products under NASA SEWP V. Cisco products are currently used throughout all of the U.S. Navy buildings located on the Philadelphia Navy Yard. NSWCPD seeks to maintain their established standard with Cisco products, because no other source has the required capability to interact with the current system in place.

For the reasons set forth herein, authorized resellers of Cisco products are the only sources that can provide these units that will enable the NSWCPD to ensure data integrity for technical analyses performed by the NSWCPD.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable IAW FAR 5.202(a)(6), this J&A will be posted along with the solicitation.

After adequate market research conducted by the technical branch, it was concluded that no other manufacturer’s equipment could replace the above referenced items to maintain functionality and interoperability. The reasoning is that the software required to operate and manage the RDT&E network is owned and copyrighted by Cisco; no other source has access to the required information to be able to provide the required functionality.

7. Determination of Fair and Reasonable Costs The Contracting Officer will determine whether the cost to the government for the supplies/services covered by this Justification and Approval are fair and reasonable, prior to award.

8. Actions to Remove Barriers to Competition For the reasons set forth in Paragraph 6, NSWCPD Code 0222 has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
