About this file

This is a Justification and Approval (J&A) document for a sole-source brand-name procurement by the Naval Sea Systems Command, Naval Surface Warfare Center, Philadelphia Division. The acquisition involves purchasing 67 Rugged Science MilCortex 4000 Standalone Brick Computers (Part Number REC-MC4006-01-K) for $443,205, to be funded by FY25 Other Procurement, Navy funding. The computers will replace legacy Operator Station Units (OSU) components on LHD/A ships as part of the Machinery Control Systems (MCS) Tech Refresh.

The document details the unique specifications of the Rugged Science hardware, including an Intel 12th Gen i7-12700TE CPU, 16GB RAM, multiple display ports, and compliance with MIL-STD requirements. The procurement is justified as a sole-source action because alternative brands cannot match the specific technical requirements, and previous competitive solicitations confirmed Rugged Science as the only responsible source. The total contract duration is estimated at six months from the award date, with no other vendors able to provide a quote during market research and a synopsis posting on SAM.gov that received no responses.

The anticipated completion date is six (6) months from the date of the award. The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition.

41 U.S.C. 1901(e)(2), sole source (including brand-name) acquisition under the authority of Simplified Procedures for Certain Commercial Items, as implemented by Federal Acquisition Regulation FAR Subpart 13.501(a) and Commercial Services.

5. Rationale Justifying Use of Cited Statutory Authority.

The Rugged Science brand is the only responsible source, and no other supplies will satisfy agency requirements based on unique characteristics that are essential to the Government. The procurement of Rugged Science brand-name MilCortex hardware is required to support LHD/A MCS Tech Refresh. This equipment must be procured on a brand-name basis from an authorized Rugged Science reseller in order to provide critical functionality to shipboard MCS systems.

This specific hardware will be replacing aging legacy OSU that have become obsolete and can no longer be supported.

The combination of specifications listed above in Section 3 are unique to the Rugged Science brand-name MilCortex. Specifications that are critical to the LHD/A MCS Tech Refresh include the requirement to be Windows 11 supported, the dimensions, weight and mounting method of the units, display port configurations, modular functionality of the front and rear access trays, and the specific type and count of the various ports. Windows 11 is required in order to remain cyber compliant. The dimensions, weight and mounting method is critical due to the limited space in the shipboard enclosures as the enclosure configuration is unable to be modified. The display ports are only compatible with very specific resolution and refresh rate that is required in order to function properly with the existing shipboard monitors as well as the planned replacement for the legacy monitors. The modularity of the unit is critical to the supportability and ease of access to perform shipboard maintenance, repair or replacement. Lastly the various connection types and counts are required to establish specific required connections with external devices; i.e., keyboard, network devices, power supplies, etc. The combination of these specifications are critical to the LHD/A MCS Tech Refresh as they ensure the functionally compatible, modernized OSU will be able to replace and improve upon the legacy OSU functionality.

Per SCD 22130, the OSU Tech Refresh design has been finalized and approved by the sponsor, PMS 321, therefore requiring this material to be installed on all 3 shipsets and the lab located at NSWCPD. This material is required to support the LHD/A MCS Tech Refresh due to unique characteristics only available in this brand, a requirement for commonality between the 3 shipsets and lab, driven by the approved Ship Change Document (SCD) 22130, Preliminary Design Review (PDR) presentations and Critical Design Review (CDR) presentations, and the completion of contract N6449823P5434 that acquired quantities of the exact same Rugged Science brand-name MilCortex materials to support 44% of the total required units. The purpose of this requisition is to acquire the remaining units to fully outfit all 3 ships and the lab.

Deviation from the Rugged Science brand name equipment would negatively affect mission critical goals as the Tech Refresh team would not have an acceptable hardware replacement for the aging legacy components. Without this modernized equipment, the legacy components would continue to become inoperable until there are no replacement parts available, halting mission objectives, software testing, and deliveries until functionality is no longer viable.

Communication and system monitorization deterioration would result in serious risk to the safety and performance of the ship as the sailors would not be receiving critical information relating to systems health, hygiene and status. Thus, the Rugged Science brand-name components are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

Alternative brands are unable to match the specifications of the Rugged Science brand-name MilCortex. Therefore, consideration of the alternative brands would potentially require approval from stakeholders, a redesign the MCS software, MCS enclosures, network infrastructure and re-consideration of all connected devices. Consideration of a product manufactured by another company would result in unacceptable delays in fulfilling the agency’s requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

This hardware is identical to the FY23 Full & Open procurement, contract number N6449823P5434. The FY23 procurement was awarded to provide the exact same hardware as identified above. Through the FY23 Full & Open contract, nine (9) proposals were received. Of those nine (9) proposals, two (2) were technically acceptable. The technically acceptable proposals were received from KPaul and Nag Marine, both of which provided proposals for the same Rugged Science brand-name MilCortex materials identified in this requisition. This adds further support that the MilCortex brand is the only responsible source, and no other brands will satisfy agency requirements.

In January 2025, KPaul, Nag Marine and original equipment manufacturer (OEM), Rugged Science, were contacted to provide a cost estimate for the materials listed above. KPaul expressed interest in supporting this opportunity but were unable to provide evidence of their capabilities.

Rugged Science also declined to provide a cost estimate but directed us to work with their sole authorized reseller, Nag Marine. The only vendor able to provide a quote was Nag Marine.

A synopsis of this procurement was published to SAM.gov on 04 March 2025 which closed on 19 March 2025. No contractors responded to the posting.

7. Determination of Fair and Reasonable Costs.

The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Competition.

For the reasons set forth in Paragraph 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
