About this file

This document is a Justification and Approval (J&A) for the use of other than full and open competition for the procurement of 14 Hexagon US Federal Sit-Down Pedestal Consoles. The consoles are required to support the modernization of the Damage Control Console (DCC) and Ballast Control Console (BCC) on LSD 49 Class ships. Hexagon US Federal is the Original Equipment Manufacturer (OEM) for these specialized consoles, and award to any other source would result in substantial duplication of cost to the Government and unacceptable delays in fulfilling the agency's requirements. The estimated value of the procurement is $700,000, with an award to Hexagon US Federal planned for September 2024. The consoles will replace obsolete legacy consoles and serve as the main Human Machine Interface for critical shipboard systems.

Hexagon US Federal Sit-Down Pedestal Operator Console.

The planned acquisition provides for the procurement of hardware equipment defined in Table 1.

The requirement is the procurement of ruggedized marine HMI consoles in support of PMS321 LSD 41/49 Class Modernization Program. The requirement will be in support of modernization of the Damage Control Console (DCC) and the Ballast Control Console (BCC) on LSD 49 Class ships executing Ship Change Document (SCD) 18028 and 18029 respectively.

The DCC and BCC hardware being procured replaces obsolete legacy consoles installed on the ship. The consoles serve as the main Human Machine Interface (HMI) for the operator for critical firefighting and ship mission capabilities by running the control system software.

These items are commercial off the shelf (COTS) parts. The estimated value is $700,000.

Previous contract, N64498-18-D-4001, awarded to Hexagon priced the Pedestal Consoles at $29,176.00 per unit. This requirement estimates the pedestal consoles at $50,000.00 per unit. The increase in cost is due to inflation and supply chain increases that has occurred through COVID and in a post-COVID environment.

Delivery is required June 1, 2025. The requirement is funded with OPN. Delivery date required is set by ship availability milestone dates set forth by lead maintenance availability team.

4. Statutory Authority Permitting Other Than Full and Open Competition.

41 U.S.C. 1901(e)(2), sole source (including brand-name) acquisition under the authority of Simplified Procedures for Certain Commercial Products and Commercial Services.

5. Rationale Justifying Use of Cited Statutory Authority.

In accordance with FAR 6.302-1(a)(2)(ii)(A) and (B), a sole source basis to Hexagon US Federal is justified as this requirement is for highly specialized supplies and services when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition as there would be a loss of commonality with existing ship DCS, BCS, and MCS hardware and it would result in unacceptable delays in fulfilling the agency’s requirements as detailed below.

Hexagon US Federal is the Original Equipment Manufacturer (OEM) for hardware equipment defined in Table 1. There are currently 57 Hexagon US Federal Pedestal Consoles deployed in the LSD 41/49 Class. This justification is for the follow-on procurement of 14 additional pedestal consoles.

The justification for a follow-on contract with the OEM is to complete the LSD41/49 Class Ballast and Damage Control Modernization efforts in accordance with the approved five (5) year install plan. The procurement of 14 additional Hexagon US Federal pedestal consoles will bring the total quantity of Hexagon US Federal pedestal consoles to 71. This would maintain common shipboard configurations, will not introduce reoccurring costs, will not introduce high schedule risk to the program, and will allow the Navy to meet the Sponsor’s requirements. No further pedestal console procurements from Hexagon US Federal will be required after the execution of this SAPCOM per the known PMS321 LSD41/49 class fielding plan provided to NSWCPD C/ 514.

Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Utilizing a new vendor to supply this highly specialized hardware for all these ship classes and unique systems would result in a substantial cost, estimated to be $630,000 additional cost for the engineering, drawing, hardware development, environmental qualifications and interoperability testing. The estimated cost is based on the historical costs of previous support contracts associated with development, integration and lifecycle support.

Table 2 below shows the breakdown of the additional $630,000 in costs. The associated government labor required consists of technical evaluations, engineering analysis, hardware requirements development and hardware testing. Material costs are associated with the cost to procure, integrate, and test new equipment duplicating existing functionality in the lab.

Table 2: Cost Estimate to Acquire from Alternate Source

Program Lab Material & Integration Drawings EQT ILS & Training System Testing

Damage Control System $100,000 $60,000 $150,000 $105,000 $25,000

Ballast Control System - $60,000 - $105,000

$25,000

TOTAL $100,000 $120,000 $150,000 $210,000 $50,000

Total NRE Cost $630,000

Table 3 below shows the overall schedule impact to the project as defined if we were to acquire from an alternate source. Lab material and integration must occur for both systems and cannot happen concurrently due to limited space and number of consoles needed. Planning yard drawing changes would take six (6) months from initial submittal of documentation of changes required via Liaison Action Record (LAR) process. EQT will take one year or more from the time of receipt of the first article unit to final report approvals accepted by NAVSEA. ILS would take an effort for 6 months to re-provision all the APLs and provide new manufacturers approved console drawings to cognizant personnel conducting the updates. System testing and integrations would consist of a two-month effort for each system that cannot occur concurrently due to converting lab environment over between efforts. If alternative source does not have fully environmentally tested units approve by NAVSEA a Shock Deficiency Correction Plan (SDCP) must be developed by NSWCPD and submitted adding additional risk to the ship and program sponsors. Total overall impact to the DCS/BCS program due to selection of alternate source would be in excess of 2 years and 8 months.

Impact 2 Years 8 Months

In conclusion, the procurement of 14 additional pedestal consoles is a follow-on to the previous procurements of 57 Hexagon US Federal Pedestal Consoles in the LSD 41/49 Class. It is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the sponsor’s requirements. This time delay would force the deferment of the installations in the current install plan. This deferment adds additional cost to the program by increasing sustainment cost of obsolete and legacy equipment due to the lack of modernization. There will be increased risk that the LSD Class ships will not be able to meet their mission objectives.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Request for Information was posted to SAM.gov on 16 April 2024. Additionally, a synopsis of this procurement was published on the SAM.Gov on 06 May 2024. No contractors have responded to either posting. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any other contractor than Hexagon Federal to provide the required supplies and services.

7. Determination of Fair and Reasonable Costs.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition.

Currently, there are no plans to procure additional Pedestal Consoles in the foreseeable future.

Should the US Navy express a need for additional units, the Government will initiate an acquisition strategy involving full and open competition to meet this requirement if the cost and schedule impact is determined to be not significant.
