About this file
This is a Brand-Name Justification and Approval document for a sole-source procurement by the Naval Sea Systems Command, Naval Surface Warfare Center, Philadelphia Division (NSWCPD).
The procurement authorizes award of a firm-fixed-price purchase order on a brand-name basis for SIEMENS industrial control hardware and associated equipment to support a Machinery Control System (MCS) Land-Based Test Environment (LBTE) hardware refresh. The acquisition includes 11 line items of SIEMENS components totaling specific quantities: ET200SP CPU (130 units), digital input modules (170 units), digital output modules (60 units), relay output modules (20 units), analog input voltage modules (30 units), analog input current modules (480 units), RTD modules (25 units), analog output modules (10 units), serial modules (5 units), base modules (80 units), and IE/Profibus gateways (87 units). Budgeted funds come from FY26 Other Procurement, Navy funding, with a requested delivery of 24 weeks from award. The statutory authority is 41 U.S.C. 1901, permitting sole-source acquisition under simplified acquisition procedures.
The justification asserts that Siemens is the only responsible source because the specified equipment must replicate shipboard Engineering Control System (ECS) components undergoing class-wide modernization, operate ECS software, accept ECS hardware configuration parameters, and support critical development and validation activities at the LBTE. Competitive alternatives from other manufacturers were evaluated but determined incompatible due to proprietary Integrated Development Environments. A Sources Sought Notice published February 10, 2026, received no responses. The contracting officer identified a minimum of four authorized Siemens distributors through Small Business Administration searches and direct outreach. The contracting officer certified fair and reasonable pricing and confirmed no future competition is planned for these supplies.

Budgeted funds will include FY26 Other Procurement, Navy funding. The total estimated dollar value of the proposed acquisition is . Requested delivery is twenty-four (24) weeks from the date of the award, there are no option quantities or periods. The Government’s minimum needs have been verified by certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition.
41 U.S.C. 1901, sole source (including brand-name) acquisition under the authority of Simplified acquisition procedures.
5. Rationale Justifying Use of Cited Statutory Authority.
Siemens is the only responsible source, and no other supplies will satisfy agency requirements based on the following unique characteristics that are essential to the Government. The specified equipment has characteristics and specifications that are unique and cannot be identified in any similar equipment offered by competitors. The procurement of Siemens brand equipment is required to support MCS RTU Tech Refresh. This equipment must be procured on a brand-name basis from an authorized Siemens distributor in order to provide critical functionality to a land-based testing environment that supports development, verification, maintenance, and diagnostics of shipboard MCS hardware and software.
The Class ECS is undergoing a technology modernization effort to replace end-of-life control equipment that supports the critical functionalities of ECS. The operating mission of the MCS LBTE is to support the ECS by providing a land-based environment that replicates the shipboard ECS system and allows development, validation, diagnostics, and long-term maintenance of ECS software and hardware configurations. This procurement intends to replace corresponding ECS components in the LBTE that are being replaced as part of the class-wide modernization effort. To fulfill the mission of the LBTE, ECS components installed in the LBTE must be capable of operating ECS software, must accept ECS hardware configuration parameters, and must operate in a manner identical to components in shipboard ECS installations. The original equipment manufacturer (OEM) of ECS components subject to this modernization effort is Siemens. As such, LBTE components must be procured on a name-brand basis from an authorized reseller of Siemens components.
Deviation from Siemens brand components would negatively affect mission critical goals of the ECS development team, as ECS software and hardware configurations could not be operated, verified, or replicated in the LBTE. Failure to fully verify and validate ECS software and configurations in a land-based environment prior to installation and operation in a tactical environment creates an unacceptable risk that ECS will not operate as intended and Ships Force operators will be unable to monitor and control critical HME equipment or perform mission critical system automation tasks. Such a situation would prevent a Class ship from being deemed fit to sail and would negatively impact War-Time Readiness. Thus, the Siemens brand-name components are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
In order to avoid limits on competition, market research of alternative brands was conducted by reviewing specifications of Industrial Control and Process Automation Equipment from other OEMs. Various products were assessed from major OEMs including
. Products were evaluated to determine if they meet the critical technological needs to support the material functionality of the ECS system, and if they are capable of operating ECS software and accepting ECS hardware configuration parameters. Products from each of these manufacturers utilize proprietary Integrated Development Environments (IDEs) that generate machine code specifically designed for execution on its own hardware. As such, products from each manufacturer were determined to be unable to operate ECS software and are incompatible with ECS hardware configuration parameters.
In an additional effort to solicit information of potential alternative brands, a Sources Sought Notice (SSN) was published on 02/10/2026, requesting information from manufacturers and vendors regarding products capable of meeting the technical needs of the ECS RTU Technology Modernization Effort. The SSN closed on 02/23/2026 with no responses received.
In an effort to solicit as many offerors as possible, a business search was conducted using the Small Business Search tool provided at www.sba.gov to locate authorized resellers of Siemens Industrial Control and Process Automation components. This search used NAICS codes 335314 (Relay and Industrial Control Manufacturing), 334513 (Instruments and Related Manufacturing for Measuring, Displaying, and Controlling Industrial Control Process Variables), and 423610 (Electrical Apparatus and Equipment, Wiring Supplies, and Related Equipment Merchant Wholesalers) with the keyword Siemens. This search provided numerous sources identifying themselves as authorized distributors for Siemens equipment. Selected results include
In addition, Siemens identified . as an authorized distributor based on geographic proximity and previous sales to government entities. Siemens provided confirmation that all products in the Siemens component catalog are available for resell by any authorized distributor. As such, a minimum of four sources have been identified as viable options for procurement of Siemens components.
7. Determination of Fair and Reasonable Costs.
The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this Justification will be fair and reasonable.
8. Actions to Remove Barriers to Competition.
This procurement completes the modernization effort for the MCS LBTE and NSWCPD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. This procurement is specific to use and installation at NSWCPD, and shipboard components related to this modernization effort will not be managed, handled, or competed by NSWCPD.
