About this file
This document is a Justification and Approval (J&A) for other than full and open competition for the procurement of a Fluke Model Number 5730AOPT03 multifunction calibrator. The justification cites 10 U.S.C. 3204(a)(1) as the statutory authority, as the Fluke calibrator is the only one that meets the Navy's requirements for accuracy, precision, and frequency range to calibrate high-accuracy multimeters in its inventory. Market research did not reveal any other commercially available products that could meet the government's needs. A sources sought notice was posted, but only one response was received from a small business partner of Fluke, who was confirmed not to be an authorized reseller. The Contracting Officer has determined the anticipated cost will be fair and reasonable using price analysis. The Navy does not have plans to compete future requirements for this item, but will assess feasibility if another potential source emerges.

J&A Number: 50,429 Ser Cod 02/0941
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitted the sole source is 10 U.S.C.
3204(a)(1), only one responsible source and no other supplies or services will satisfy agency requirements as implemented by FAR 6.302-1.
5. Rationale Justifying Use of Cited Statutory Authority.
The statutory authority permitting other than full and open competition applies to the proposed procurement because the Fluke Model Number 5730AOPT03 is the only multifunction calibrator that is accurate and precise enough to obtain a less than Probability of False Acceptance (PFA) while calibrating the high accuracy multimeters in the Navy’s inventory. The Wideband option extends the frequency ranges to meet the Navy’s requirement to calibrate instruments up to MHz. It has been proven to source reliable and repeatable outputs, reducing uncertainties during calibration and improving the confidence level of measurements.
Fluke is the Original Equipment Manufacturer (OEM) of current fleet assets. Due to the equipment being highly specialized, the Meter Calibrator 115V with Wideband Option, Model Number 5730AOPT03 from the OEM, Fluke, are the only calibrators that can withstand the stress of calibrating support equipment while maintaining accuracy and precision, which is required to meet agency needs. Navy personnel require these calibration standards in shore-based and ship based calibration laboratories to calibrate many electrical standards and equipment found in the Navy inventory.
Additionally, the required Fluke calibrators will replace calibration standards that have lost functionality due to broken parts or ageing internal components. The Meter Calibrator 115V with Wideband Option, Model Number 5730AOPT03, directly supports instrument calibration procedures and is a modernized replacement for the older Multifunction Calibrator, which is being phased out, that supports over instrument calibration procedures. If any other Multifunction Calibrator was procured it would cost no less than and Months to rewrite, bench-test, Quality Assurance check, calibration interval analysis and or data element/database support/updates the procedures if any other equipment were procured.
These multifunction calibrators have a high accuracy that allows technicians to obtain test accuracy ratio of for meters that display up to digits, and no other parts will satisfy these requirements or can be modified to meet requirements.
For the reasons stated above, there is only one responsible source and no other parts will satisfy requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted to determine if a multifunction calibrator capable of meeting the Government’s requirement was available in the commercial market place. Market research using web-based searches including GSA Advantage, Google, Bing, and NAVICPmart did not reveal did not reveal any other products that can meet Government needs or be modified to meet Government needs, other than Fluke, the OEM. The market research that was conducted revealed that Fluke produced the only multifunction calibrator capable of meeting the Government’s minimum requirements.
A Sources Sought Notice (SSN) was posted on SAM.gov requesting any interested Offeror’s to submit their company’s capability statements to meet the specifications listed in the Statement of Work. The posting was issued on 24 April 2023 and closed on 08 May 2023. At the close of the SSN, one (1) response was received from , a Service Disabled Veteran Owned Small Business & HUBZone Small Business, stating they were a small business partner for Fluke. However, Fluke confirmed that there are no authorized resellers or distributions for the specified part number. Additionally, confirmed that they are not an authorized reseller or distributor for the specific Fluke part number.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined that the anticipated cost to the Government for the items covered by this J&A will be fair and reasonable. The Contracting Officer will utilize price analysis, including commercial price lists and historical information to determine that the final price to the Government is fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in paragraph 5, Corona Division no plans at this time to compete future requirements for the types of supplies covered by this document. If another potential source emerges, Corona Division will assess whether competition of future requirements is feasible.
