DEPARTMENT OF THE NAVY
NAVAL SURFACE WARFARE CENTER
CORONA DIVISION
PO BOX 5000
CORONA, CA 92878-5000
IN REPLY REFER TO
J&A Number: 50015
Code: CT01
P.R. Number: 1300384961
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. REQUIRING ACTIVITY AND CONTRACTING ACTIVITY:
The contracting activity is the Naval Surface Warfare Center, Corona Division (NSWC CO), Acquisition Division, Code CT01. The requiring activity is the Range Systems Engineering Department
Code RS 31, Range Sustainment & Geomatic Engineering Branch, NSWC CO, Corona, CA.
2. DESCRIPTION OF THE ACTION BEING APPROVED:
Award of a firm fixed price (FFP) contract on a sole source basis for a Submersible Marine Marker Buoy
System from Fiomarine Industries Pty Limited, 30-38 Innovation Drive, Glenorchy Tasmania, Australia
7010.
3. DESCRIPTION OF SUPPLIES/SERVICES:
The NSWC CO (Code RS31) has been tasked to procure Submersible Marine Marker Buoy system equipment for the Naval Munitions Command Mobil Mine Assembly Group (COMOMAG), headquartered in San Diego CA, and the CONUS West Division (NMC CWD) Unit, located at Seal Beach CA.
This equipment supports Seventh and Fifth Fleet training exercises and testing, as well as Third Fleet and
Fleet Forces areas of operation. This system is employed for Tactical Training in traditional and non-traditional NAVSEA range locations where minefields exceed diver capabilities, diver services are not available, or cost is prohibitive for unmanned systems. The system enables the employment of Mine targets in tactically significant locations simulating operational plans, and deployment of Naval Mine
Warfare Forces (to train) in realistic environmental conditions. The system is employed and specifically requested for use in several training exercises: RIMPAC, BOLD ALLIGATOR, DAWN BLITZ, FOAL
EAGLE, SHAMAL, IMCMEX and for deeper water ranges in AUTEC as well as others - supporting up to 80 targets for as long as 18 to 180 days during a single mission. It will require an estimated $1.5 million to $2 million to produce a product that meets the form, fit, and function of this requirement. If replacement equipment is not acquired, training and testing will be severely impacted.
The total estimated value of this acquisition is $280,030.26 for the Submersible Marine Marker Buoy systems and spare equipment:

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The required Submersible Marine Marker Buoy System and spare equipment are listed in table above. A firm fixed price type contract is anticipated. Period of performance is 150 days after contract award.
4. STATUTORY AUTHORITY PERMITTING SOLE SOURCE:
10 U.S.C.2304(c)(1). Only one responsible source and no other supplies or services will satisfy agency requirements.
5. RATIONAL JUSTIFYING USE OF CITED STATUTORY AUTHORITY:
The equipment is “direct replacement”. Submersible Marine Marker and Retrieval System can be described as supporting deep water moored mines and targets during Naval Tactical Training exercises, testing and evaluation. As stated previously, an estimated $1.5 million to $2 million would be required to produce a product equivalent to this item. Previously contracts with Fiomarine
Industries for this product include N00244-07-D-0044 and N00244-05-D-0066.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS
AS PRACTICAL:
Market research conducted was unable to identify alternate manufacturers of items with the same form/fit/functional specifications. Special Notice has been posted on 28 Jun 13 and no responses have been received.
7. DETERMINATION OF FAIR AND REASONABLE COSTS:
The Contracting Officer has determined that the anticipated cost to the Government for the item covered by this J&A will be fair and reasonable. The Contracting Officer will use price analysis, including historical cost estimating relationships from previous procurements, to determine that the final price to the

Government is fair and reasonable. Assistance from the Defense Contract Audit Agency (DCAA), the
Defense Contract Management Agency (DCMA), and the Contracting Officer Representative (COR) or
Engineering Requirements Officer (ERO) will be utilized to analyze, evaluate and negotiate based upon detailed pricing data, which will be certified by TASC at the conclusion of negotiations. The Contracting
Officer has determined that the anticipated cost to the Government for the supplies/services covered by this J&A will be fair and reasonable.
8. ACTION TO REMOVE BARRIERS TO FUTURE COMPETITION:
For the reason set forth in paragraph 5 above, there are no plans at this time to compete future requirements for the types of services or product covered by this document. If another potential source emerges, NSWC Corona Division will assess whether competition for future requirement is feasible.
