About this file
This document is a Justification and Approval (J&A) for a sole source procurement of maintenance consoles by the Naval Surface Warfare Center, Port Hueneme Division (NSWC PHD). Systel Inc. is the sole manufacturer and holder of proprietary rights to the designs, and no other sources were found capable of meeting the Government's requirements. The J&A states that using an alternate source would result in approximately $660,000 in duplication of costs and a 1.5-year delay, which would negatively impact operational availability and mission readiness. A sources sought notice was posted, but no other capable vendors were identified. The Contracting Officer has determined the anticipated costs will be fair and reasonable. The NSWC PHD Contracts Office will continue to conduct market research to identify potential future competition.
The related federal contract opportunity is for the procurement of the maintenance consoles under Solicitation Number N6339424Q0028, with the requirement described as "24Q0028 - Maintenance Consoles".

Navy Marine Corps Acquisition Regulation Supplement
APRIL 2018 (Change 18-24) J&A No.: NSWC-PHD-JA-24-046 therefore, specifically identified in Drawing No. --s a primary component of the assembly. No other maintenance consoles have assed E T and the technical drawings do not include an alternate part number for use in the ssembly. Systel Inc. stated they are the sole manufacturer of the maintenance consoles, holding proprietary rights to the designs and do not have any authorized third-party distributors or resellers. Systel Inc. is the only source that can meet NSWC PHD's needs. lfNSWC PHD were to use a different source, it would incur a substantial duplication of cost of approximately $660,000 that is not expected to be recovered through competition and an unreasonable delay of approximately 1.5 years to identify and test for alternates. Such costs and delay would negatively affect operational availability and mission readiness ofthenboard U.S. Navy ships. These estimates are derived from the costs and time requirements from the initial EQT testing; this estimate includes the costs for labor, travel, non-recoverable materials, test plan development, and analysis of results.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Systel Inc. does not have any authorized distributors of their products as they do all their own sales and have complete control over their proprietary designs and products. This information was relayed via email by Systel Inc. on 14 December 2023.
Contract specialist/buyer posted a sources sought to SAM.gov from 28 March 2024 through 08 April 2024 and received two responses from interested vendors. Neither vendor was found to be capable as Systel Inc. does not have authorized resellers.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
NSWC PHD Contracts Office will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
