About this file

This document is a Justification and Approval (J&A) for the use of other than full and open competition to procure Dell hardware for the Naval Surface Warfare Center, Port Hueneme Division (NSWC PHD).

NSWC PHD intends to award a single firm-fixed price contract for 6 Dell PowerEdge R550 Servers, 20 Dell Latitude 5430 Rugged Laptops, 20 Dell Thunderbolt docks, 20 Dell m.2 PCIE NVME SSDs, and 9 Dell Precision 5860 Desktop Towers. This new Dell hardware is required to replace existing end-of-life Dell hardware supporting the RDT&E Radar Support System. The new hardware must be compatible with the existing IT infrastructure. Market research identified 3 capable vendors - Lyme Computer Systems ($304,715.26), SHI ($299,789.47), and Thundercat Technology ($277,917.97). NSWC PHD has determined the anticipated cost is fair and reasonable. The J&A cites 10 U.S.C 2304(c)(1) as the statutory authority, noting that using another brand would require substantial infrastructure updates at an additional cost of approximately $325,000 and cause unreasonable delay. NSWC PHD will continue market research to identify potential future competition.

Navy Marine Corps Acquisition Regulation Supplement

APRIL 2018 (Change 18-24)

ANNEX 1 – JUSTIFICATION AND APPROVAL

J&A No. NWSC-PHD-JA-24-039

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Surface Warfare Center, Port Hueneme Division, (NSWC PHD).

2. Description of the Action Being Approved.

NSWC PHD intends to award a single firm-fixed price contract on the basis of other than full competition as a brand name requirement for quantity six Dell PowerEdge R550 Servers, quantity 20 Dell Latitude 5430 Rugged Laptops, quantity 20 Dell Thunderbolt docks, quantity 20

Dell m.2 Peripheral Component Interconnect Express (PCIE) Non-Volatile Memory Express

(NVME) Solid State Drives (SSDs), and quantity nine Dell Precision 5860 Desktop Towers supporting the Research, Development, Test, & Evaluation (RDT&E), Radar Support System.

3. Description of Supplies/Services.

NSWC PHD is procuring new Dell hardware to replace existing end-of-life (EOL) Dell hardware on-site at the Virginia Beach Detachment. This Dell hardware supports the RDT&E Radar

Support System. The new Dell hardware must meet the form, fit, and function to integrate with existing information technology infrastructure on-site.

The certifying technical and requirements personnel have verified the government’s minimum needs.

Estimated Dollar Value

FY24

Total

RDT&E $300,000

OPN

O&MN

Total $300,000

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C 2304 (c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

NSWC PHD requires Dell hardware to ensure compatibility (form, fit, function) with existing on-site Dell hardware, software images, and parts. This new Dell hardware will be a direct replacement for existing Dell hardware already in use on-site. All hardware in use on-site in the

RDT&E Radar Support System (RSS) must be fully integrated with the other hardware. For instance, docking stations, computers, and existing hardware must integrate seamlessly both together and with the existing software. If another brand were used, NSWC PHD would need to update the infrastructure and part replacement to match and be compatible with the new brand of equipment which would result in a substantial duplication of cost of approximately $325,000 that is not expected to be recovered through competition. Additionally, NSWC PHD would need to gain the RDT&E system’s RMF approval to use a new brand and conduct 200 hours of training for assigned personal which would result in an additional unreasonable delay.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

During market research five vendors were contacted and pricing documents were received from three capable and interested vendors: Lyme Computer Systems ($304,715.26), SHI

($299,789.47), and Thundercat Technology ($277,917.97).

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For reasons set forth in Paragraph 5, NSWC PHD will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
