JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Port Hueneme Division, (NSWC PHD), Contracts Department, Code 02.
2. Description of the Action Being Approved
NSWC PHD intends to award a single contract on the basis of other than full and open competition to Vishay Hirel Systems, LLC in support of Air Dominance Department (Code A50) for the purchase of five units of Vishay Power Supply (P/N 5000130B) and five units of Vishay Power Conditioner (P/N 92701).
3. Description of Supplies/Services
The NSWC PHD Air Dominance Department (Code A50) is responsible for the design of the Vertical Launching System (VLS), Next Generation 2 (NG-2) Launch Control Units (LCU). The VLS is a surface ship combatant missile launcher that stores and launches a variety of missile types. The Launch Control Unit (LCU) acts as the interface between the Weapons Control Systems (WCS) and the launcher.
The duties of the LCU include selecting, preparing and launching missiles, as well as reporting hazards and faults that occur in the launcher. The LCU uses the AN/UYQ-70 computer that is specifically configured to support VLS functions. The Vishay Power Supply and Vishay Power Conditioner are critical components used in the assembly of the Vertical Launching System (VLS), Next Generation 2 (NG-2) Launch Control Units (LCU).
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
The total estimated value of the requirement is $180,647.55 and is composed of the following funding sources:

Fund Type QTY Part Number FY 17 Total Contract

4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2); Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use Of Cited Statutory Authority
Pursuant to 10 U.S.C. 2304(c)(1), as implemented in FAR 6.302-1(a)(2), Vishay Hirel Systems, LLC is the only responsible source as it is the only qualified source for power supplies and conditioners capable of supporting the MK41 VLS NG-2 LCUs.
To qualify alternate sources that can meet the requirements will cause a substantial duplication of cost to the Government that is not expected to be recovered through competition. NSWC PHD estimates that it would incur a substantial duplication of cost of to obtain another qualify another source. The basis of this estimate is derived from previous experience with the Baseline VII Tech Refresh efforts from 2011-2016. To ensure that any new sources are capable of producing a product that meets the established performance requirements, the Government will have to incur costs to conduct First Article Tests, Physical Configuration Audits (PCAs), and Shock and Vibration testing. Since the value of this requirement is only $180,647.55, the Government does not expect to recover these projected costs through its competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
An email was sent to Vishay Hirel Systems, LLC on 26 June 2017 inquiring about distributors for these two supplies and the response was that there are no distributors (see tab four). A Sources Sought notice was posted from 03 July 2017 to 06 July 2017 and no responses were received. No additional market research was conducted because it is not practicable, for the reasons discussed in Paragraph 5 above, for any company other than Vishay Hirel Systems, LLC to provide the required supplies.
7. Determination Of Fair And Reasonable Price
The Contracting Officer will use price analysis, to the extent of including historical price estimating relationships from previous Vishay Power Supply and Power Conditioner procurements, to determine that the final price to the Government is fair and reasonable. The Contracting Officer has determined that the anticipated cost to the Government for the supplies and services covered by this J&A will be fair and reasonable.
8. Actions To Remove Barriers To Future Competition
For the reasons set forth in Paragraph 5, NSWC PHD Contracts Department has no plans at this time to compete future contracts for the types of supplies covered by this document. If any potential sources emerge, the Government will assess whether competition for future requirements is feasible.
