5. Rationale Justifying Use of Cited Statutory Authority

Contract N00178-lO--D--6l24-LEOl provides engineering services critical to the mission of the Land Attack Department (L Department) of the Port Hueneme Division, Naval Surface Warfare Center. This essential support is in jeopardy of ceasing by 19 september 2014 due to unavoidable delays encountered with the award of the follow-on contract.

Therefore a bridge contract with a base period of performance and two option periods is required in order to avoid loss of continuity of service to the L Dept. and allow for a transition period after award of the follow-on contract. Option periods are necessary in the event unforeseen circumstances arise.

The incumbent contractor, JSL, is the only source with the requisite knowledge to ensure continuity of services and prevent unacceptable delays in -fulfilling these services in the required time period .~.\new contractor cannot acquire and organize a workforce and develop the technical expertise necessary to perform this effort by the required start date.

Any delays in coverage would seriously disrupt and impact the Government’s ability to support vital events, If Services cease, there will he an extreme delay to or cessation of mission critical work that is necessary to prepare -the ships to go to sea with a reasonable expectation of safe and effective operation. Deployment of assets without adequate capabilities could jeopardize a ship’s missibn and negatively impact national defense capability. The tasks that are currently performed by this contracting effort include:

technical support services in systems engineering, engineering analysis, testing, evaluation, and software verification/validation are being performed for a broad spectrum of ship classes, combat and weapon systems, and operational requirements. Without these efforts continuing, the fleet will be negatively impacted.

Specifically, the efforts detailed in paragraph three will not be performed, which will negatively affect fleet readiness and impact the accomplishment of follow-on tests in support of TECHEVAIJ and OPEVAL. Key efforts to be performed in the period include but are not limited to the following:

o Mine Countermeasure (MCM) Developmental Testing ~DT) MCM DT-32 onboard the TJSS INDEPENDENCE (LCS 2).

o Surface Warfare (suw) Mission Package (MP) Developmental Testing DT/IT-B4 onboard USS CORONADO (IjCS 4)

Anti-Submarine Warfare (ASW) NP Developmental Testing DT/ADM onboard USS FREEDOM (LCS 1)

Successful accomplishment of these test events are TECHEVAL/OPEVAL entrance criteria requirements. DT events will be required to be rescheduled causing further delays in the overall TECHEVAL and OPEVAL testing program impacting completion of milestone requirements for the program. Testing is currently in progress and is scheduled to continue until the end of FY15. Contractor personnel are currently serving as test officers, leading the test teams comprised of representatives from other warfare centers and program offices. They are also executing testing in accordance with the scenario certification package and Test and Evaluation Master Plan (TEMP TEIN 1695) of the MCM Mission Package, Increment 2 SOW Mission Package, and ASW Mission Package respectively. If cessation of work occurs, L Department will be unable to support the following planned events:

o DT/Operational Test (CT) D-7 event for the Tomahawk Command and Control System (TC2S) , which is scheduled from Oct 20 through Oct 24, 2014. Contractor personnel are currently supporting the pre -planning efforts in preparation for the test event and are needed to support the test event as well. Without this support, the TC2S5O1
