Justification and Approval for Use of Other Than Full and Open Competition
This document is a Justification and Approval for Use of Other Than Full and Open Competition issued by the Naval Criminal Investigative Service-Headquarters (NCIS-HQ), Business Operations Directorate, Acquisitions Division, for a sole source contract award. NCIS seeks to procure a Regional Communications System (RCS) subscription for forty-one (41) NCIS-owned radios to provide dedicated encrypted talk groups on the public service radio system covering San Diego and Imperial County service areas. The service is required for criminal investigations and surveillance operations within the region, enabling NCIS agents to monitor, communicate, and report activities from the field while maintaining interoperable communications infrastructure.
The requirement spans five one-year subscription periods from July 1, 2026, through June 30, 2031, with the place of performance in San Diego County and Imperial Counties, California. The sole source is the County of San Diego (CAGE: 1WAM7, UEI: SG98APEZBLZ6), which exclusively manages the Regional Communications System through the San Diego Sheriff's Office. The justification cites 10 U.S.C. 3204(a)(1) as the primary statutory authority, establishing that only one responsible source exists and no other supplies or services will satisfy agency requirements. Market research confirmed that the County of San Diego is the sole provider of the RCS; no alternative public service radio system covers the required operational area. The acquisition is conducted under FAR 13.106-1(b)(1)(i) procedures for soliciting from a single source, with pricing to be reviewed using price analysis techniques per FAR 13.106(a) prior to award. The fiscal year 2026 appropriation code is OM&N.

The justification rationale for restricting competition is: the Radio Communications system in proprietary to San Diego County (CAGE: 1WAM7), and managed by the San Diego Sheriff’s Office. There are no other providers or resellers. This service fulfills a need for encrypted and interoperable communications for NCIS’ operations and investigations in Southern California.

Describe in detail why only this/these suggested source(s) can furnish the requirement(s) to the exclusion of other sources.
A long-range public service radio system is required for criminal investigation and surveillance operations within San Diego County and surrounding areas. The County of San Diego’s radio system’s programming and encryption is the only one who fulfills the need for safe and interoperable communications in the area and it’s currently used by multiple agencies that conduct operations in the region.
This is the public service radio system for San Diego and Imperial Counties. There is no other public service radio system that covers the required operational area. Getting dedicated encrypted talk groups on this wide area system requires its use.

Pricing will be reviewed prior to award based on price analysis techniques available per FAR 13.106(a).
