1. The service or supply listed on N63285-19-SU-15016 is sole source and competition is precluded for reasons indicated below. There are no substitutes available for this material or service.

3. Identification of the justification rationale. The acquisition is being conducted under the authority of Federal Acquisition Regulation (FAR) 13.106-1(b) Soliciting from a single source. The justification for restricting competition is
(1) For purchases not exceeding the simplified acquisition threshold.
(i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

The proposed acquisition requirement is to acquire NEXTEST software support maintenance for the period of 10/15/2018-10/14/2019.

The nexTest NCIC CJIS Exam application code is proprietary to Peak Performance Solutions
(PPS).
This is service an existing NCIS NCIC nexTest CJIS EXAM Software; support is proprietary to PPS, because they wrote the code/application. The application is written to allow NCIS OpenFox Messenger NCIC
Operators to sign on via web based interface and take an NCIC CJIS Exam to maintain certification. The application interfaces with the NCIS OpenFox Messenger Software (NOMS) to update the Operators certification for 2years from the date they pass the exam. (the update is all automated with no manual updating required).
The nexTest application is installed and operational in the NCIS NIPRNET DMZ on a Windows based server and interfaces with the NCIS Unix based Law Enforcement Server/System (NOMS) also in the NCIS
NIPRNET DMZ.
6. Other information to support a sole source buy:
The proprietary data is: PPS nexTest application/code is written and maintained by them; access to maintain this software on the Windows based server is via an existing point to point NLETS Circuit
NCIS currently owns the Nextest licenses. This requirement is only to maintain the existing licenses already owned by NCIS
