FOR USE OF OTHER THAN FULL AND OPEN COMPETITION JUSTIFICATION

1. Contracting Activity

The Contracting Activity is the Supervisor of Shipbuilding, Conversion & Repair (SSGR), USN, Groton, CT 06340.

This justification provides for limiting the source of the procurement to VACCO Industries, 10350 VACCO ST. South El Monte, CA 91733-3316.

3. Description of Supplies/Services

The proposed contract action requires VACCO Industries to provide the parts/supplies necessary to rebuild High Pressure Air Reducers on multiple classes of U.S. Navy submarines. The acquisition is for supplies only; it does not require any services from VACCO Industries. The required delivery date for all the items listed above is 1 October 2019. The requested material represents the minimum requirements of the government and have been verified by certifying technical and requirements personnel. The requirement has an estimated dollar value of $540,230and will be Fiscal Year 2019 Operations & Maintenance (OM&N) funding.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1). Only one responsible source and no other supplies will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

The procurement of the supplies described above using other than full and open competition is appropriate in accordance with Federal Acquisition Regulation (FAR) 6.302-1(b)(1)(i):

Unique supplies (or services) available from only one source or only one supplier with unique capabilities. Additionally, using other than full and open competition is proper here under FAR 6.302-1(b)(2), because VACCO Industries is the patent holder and Original Equipment manufacturer (OEM). Therefore, VACCO Industries is the only source available that can realistically supply the necessary parts listed above.

A fundamental objective underlying the submarine program is that of attaining and maintaining maximum sustained level of deployment of submarines and requisite personnel. The strategic importance of the submarine program and the direction relationship of efficient operation and the ships’ readiness posture are of vital concern. Submarine systems are extremely complicated and require the use of unique parts and highly technical expertise especially for systems that are electrical or mechanical in nature. To minimize the potential of having an undesirable schedule impact associated with unresolved technical problems, it is necessary to quickly restore or maintain submarines to a fully operational level at all times.

To that end, this procurement is specific and unique to submarine air system regulating valve repairs and is required in support of emergent repairs to mandatory ship’s equipment. These air regulating valves, manufactured only by VACCO, reduce high pressure air to a lower, sustainable pressure necessary to support operation of vital ship systems. The two current provisioning and supply systems, Defense Logistics Agency (DLA) and Naval Supply Systems Command (NAVSUP), are unable to source these specific repair parts which are required to meet operational submarine emergent maintenance and repair demands. Failure to purchase these specific air regulating valves manufactured only by VACCO for LOS ANGELES and VIRGINIA Class submarines will result in the inability of Naval Submarine Support Facility (NSSF) personnel to accomplish mandatory repairs and will prevent the ships from meeting operational commitments established by higher authority.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

In accordance with FAR 5.201, the proposed contract N6278989Q0001 was synopsized on the Federal Business Opportunities (FedBizOpps) website on December 11, 2018 and remained open until January 31, 2019. During that time period, no inquiries were received.

No additional market research was conducted because it not to practicable, for the reasons identified in paragraph 5 above, for any company other than VACCO Industries to provide the required valves are manufactured by VACCO or be repaired with OEM parts.

J&A Number: 19,063

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable. Fair and reasonable will be determined using previous invoices and/or contracts where VACCO Industries sold these same parts to other commands.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, SSGR has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, SSGR will assess whether competition for future requirements is feasible.
