MEMORANDUM TO THE FILE

Subj: JUSTIFICATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

FOR AN ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

I. BACKGROUND:

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

2. As required by FAR 13.106-3(b)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement (or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

SOSB requires HITACHI Camera monitoring devices to support DDG-1000 Class visual monitoring in conjunction with the installed communications network to provide compatible monitoring. The equipment is required by Nov 15th 2016.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS

BASED ON THE FOLLOWING (select all that apply):

A. _X__ ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

__X_ EXCLUSIVE LICENSING AGREEMENTS. HITACHI is the only brand qualified to meet these mission requirements. The general characteristics of many of the items cannot be met with alternative items, due to the requirement to visual and monitoring standards and ability to integrate with the DDG-1000 installed network and monitoring system. These parts are commercial off the shelf items that are replacements to an obsolete camera. This camera was is a form fit function replacement identified by a Raytheon engineering study to fit the current installed camera network. The above listed vendor is the sole authority that can provide the required configuration. The compatibility of this item has to be assessed not only with the item itself, but also with the attendant system hardware infrastructure. Due to the nature of the DDG 1000 Class the integration of hardware and software subsystems is extremely complex. The compatibility testing and assessment efforts would be extensive and costly.

Additionally, a compatibility assessment would require test time at an engineering test facility where time is scheduled six (6) months to one (1) year in advance. This would slow the compatibility assessments dramatically for each item and would require its own individual assessment plan. As a result, this would cause significant schedule delays.

These material items are required to support DDG 1001 Class HM&E activation in FY 2017. The longest lead time is unknown due to previous solicitation with no bid. If a compatibility assessment had to be scheduled for an alternative item, an additional six (6) to twelve (12) months would be required. Therefore no other sources, other than the brand-name discussed above, can meet the Government’s requirements.

2. ___ OTHER REASONS.

B. __ BRAND NAME

C. ___URGENT AND COMPELLING. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required:

V. CERTIFICATIONS:

A. Technical / Requirements Certification: I certify that the facts and representation under my cognizance which are included in this justification are complete and accurate to the best of my knowledge and belief.
