Attachment 2 - N6264523R0005 Opiate RFP Questions & Answers - Revised 11-9-2022
Questions in Black. Answers in Red Italic
1. Question pertaining to our description of an Offeror’s past performance on up to 3 contracts within the last 5 years for the same or similar immunoassay reagents referenced below:
“2.1. The Offeror shall describe its past performance on up to three contracts it has held within the last five years that are for the same or similar immunoassay reagents to that which is detailed in this solicitation, or affirmatively state the Offeror possesses no relevant past performance directly related to or similar past performance. Descriptions of contracts in excess of the stated limited of three will not be evaluated. Offerors who present similar contracts shall provide a detailed explanation demonstrating the relevance of the contracts to the requirements of the solicitation. The Government reserves the right to contact any references.”
Assuming a vendor has experience, supplying the same immunoassay reagent (i.e., Opiates) and two (2) similar immunoassay reagents (i.e., Oxycodone, Hydrocodone, Fentanyl, Oxazepam, etc...) on separate contracts to the Department of Defense DDRP.
a. Would it be sufficient to list and describe our past performance on those three separate contracts in this section?
A: Yes it would be acceptable to list past performance on DDRP contracts to complete this requirement.
b. Or was the intent to have the Offeror list 3 separate references/contracts supplying the immunoassay reagent in question?
A: If three contracts with DDRP do not exist within the specified timeframe, other separate references can be listed.
2. Can you please provide the Laboratory Information System (LIS) for each site listed in solicitation? (This will assist with post-analytical workflow options vendor is considering offering as value-add inclusions to the Cost Per Test (CPT) pricing.)
a. Great Lakes
b. Jacksonville
c. Lackland
d. Fort Meade
e. Tripler
f. Dover
A: The DDRP will not provide this information for the purposes of the vendor “adding value” because it is not a requirement of the solicitation.
3. Offeror will be providing a copy of our Small Business Contracting Plan for 2022. Solicitation #
N6264523R0005 also requests a subcontracting plan (if applicable).
Do you have a subcontracting template that can be provided to all vendors?
A: DoD Office of Small Business Programs (SBP) has resources at the following website:
Small Business Professionals (Government and Industry) (defense.gov)
Sample templates are available via the links at the SBP website and copied below.
The appendices in the guidance document are also provided as separate stand-alone documents:
DoD Subcontracting Program -- The Basics of Subcontracting DoD Checklist for Reviewing Subcontracting Plans DoD Subcontracting Program -- Guide to Preparing and Reviewing an Individual Subcontract
Report (ISR) for an Individual Subcontracting Plan DoD Subcontracting Program -- Guide to Preparing and Reviewing a Summary Subcontract
Report (SSR) for an Individual Subcontracting Plan DoD Subcontracting Program -- Guide to Preparing and Reviewing a Summary Subcontract
Report (SSR) for a Commercial Subcontracting Plan
4. Offeror will be working with a subcontractor with specialty experience related to this solicitation. What is the best way to incorporate the past performance of our subcontractor in the solicitation submission?"
A: DDRP is looking for the Offerors past performance only. The Offeror is allowed to use subcontractors but the subcontractors past performance will not be considered as past performance for the Offeror.
5. Are small business Offerors required to submit a small business participation plan and/or subcontracting plan?
A: - Small Business Offerors should submit only a Small Business Participation Commitment (SBPC).
- Other than small (Large Businesses) should submit a Small Business Participation Commitment AND a
Small Business Subcontracting Plan.
6. Are there any Page limits on Volume I or Volume IV content submitted?
A: There is No limit to the Pages for Volume I and Volume IV. (Page 20 of 52) CS will insert Paragraph identifier of 4.16
7. Is there any circumstances or equipment other than Beckman Coulter AU5800 to consider for the instruction sheet described in the Statement of Work, 1.4 on Page 5 of 52?
A: DDRP: No. Requirement is to support only the installed Beckman Coulter AU5800 devices.
8. Is there an attachment 2 described in 4. Volume IV: Business Proposal, 4.12 on Page 19 of 52?
A: A copy of the SAM registration will suffice.
Solicitation language revised: The Offeror shall complete the SAM Certification Sheet (Refer to Attachment 2).
New language: The Offeror shall include a PDF copy of their current SAM.gov Entity Registration reflecting the Active Registration Status, Expiration Date and Cage Number.
9. Please confirm that the participation plan goals only apply to the Small Business Participation Commitment Plan and not to the Subcontracting Plan. If these goals are to apply to both plans, please confirm that offerors who have approved commercial subcontracting plans that do not align with the utilization goals set for this procurement would still be eligible for award. Under FAR 19.704(d)(1), “approved commercial plan shall remain in effect during the contractor’s fiscal year for all Government contracts in effect during that period.”
A: The correct designation is Small Business Participation Commitment not Participation Plan.
The solicitation will be revised to reflect this updated title.
Goals apply to both Small Business Participation Commitment and the Subcontracting Plan
10. Evaluation Factor C- Volume III requires Other Than Small (Large Businesses) submit a Small Business Participation Commitment and a small business subcontracting plan. The participation plan appears to be an individual subcontracting plan. Some offerors may already have commercial subcontracting plans, which would cover this contract. Under FAR 19.704(d)(1), “approved commercial plan shall remain in effect during the contractor’s fiscal year for all Government contracts in effect during that period.” Please clarify the requirement for offerors with approved commercial plans.
A: Offerors can submit a copy of the approved commercial plan to meet the requirement.
However, an Individual Subcontracting Plan may be appropriate to improve evaluation results if Offeror identifies target small businesses in categories that exceed the percentages in the commercial plan.
11. Do you accept exclusions and revisions? Specifically:
a. Can Offeror propose alternate solutions to the required SOW which Offeror believes provides an advantage to the government?
A: Offeror should provide one answer in response to SOW as advertised. If Offeror has alternative solutions they feel add value, or provide an advantage to the Government, these can be included as Proposal Option (Alternative) 1, 2 etc.
b. How should an Offeror address FAR clauses that they feel might not be applicable or can’t be complied with?
A: If Offeror feels a FAR clause is Not Applicable, it should be marked N/A supported by sufficient comments detailing exactly why it does not apply. If it cannot be complied with, list information explaining why not; and how the performance of the SOW is not at risk. This data will be reviewed, but not necessarily change the Evaluation scoring.
12. For any contracts with NMLC for DDRP, who should Offeror list as an appropriate Point Of Contact (POC) within the response for past performance and current contracts?
A: The Ordering Officers at the various labs who have routinely supported prior order placement would be the appropriate POC to be listed.
