The Government intends to award one (1) indefinite delivery indefinite quantity (IDIQ) contract with firm-fixed price delivery orders from the issuance of this solicitation to the responsible proposal that is determined to be the Lowest Priced Technically Acceptable (LPTA) proposal, which shall represent best value to the Government. Award shall be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors (i.e. technical conformance to the requirements of the solicitation).

The proposals will be evaluated under the following factors:

Evaluation Factor I: Conformance to Essential Characteristics Evaluation Factor II: Past Performance Evaluation Factor III: Small Business Subcontracting Plan Evaluation Factor IV: Price

Relative Importance of Factors. The relative importance of each factor is as follows:

Evaluation Factor’s I, II and III will be evaluated individually on a pass/fail basis. If an offeror's technical proposal is determined to have failed under Evaluation Factors I, II or III, the offeror’s proposal will receive no further consideration for award unless there are no other technically compliant proposals.

If an offeror is determined to have passed under Evaluation Factors I, II and III then the offeror’s proposal will be further evaluated on Evaluation Factor IV, Price. In doing so, Factors I, II and III are all equally important. If Factors I, II and III have all been evaluated and received a ‘pass’ rating, Factor IV (Price) will be the deciding factor as the Lowest Price Technically Acceptable (LPTA). For LPTA, Factor IV is equally important to the combination of evaluation Factors I, II and III.

Volume I – Non-Price Factors

Evaluation Factor I: Conformance to Essential Characteristics:

The proposal will be evaluated to determine if the proposal meets all of the requirements specified in the Essential Characteristics section of this solicitation.

This will be rated as either Pass or Fail.

Evaluation Factor II: Past Performance:

The Past Performance will be evaluated as either Pass or Fail, in accordance with FAR 13.106-2(b)(3)(ii)(C), by using the information retrieved from the Past Performance Information Retrieval System (PPIRS).

Evaluation Factor III – Small Business Subcontracting Plan:

All offerors (both large and small businesses) will be evaluated on the level of small business commitment that they are demonstrating for the proposed acquisition, and their level of commitment to utilizing small businesses in performance of prior contracts. The small business participation plan factor will be evaluated on an "Acceptable (Pass)" or "Unacceptable (Fail)" basis and one of these ratings will be assigned accordingly

Volume II – Price

Evaluation Factor IV – Price:

Price will be evaluated on completeness and reasonableness.

Completeness –

The offeror shall include pricing for all line items (as stated in the INSTRUCTIONS TO OFFERORS – ADDENDUM TO 52.212-1).

(1) [ ___ ] Are, [ ___ ] are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) [ ___ ] Have, [ ___ ] have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; and

(4) [ ___ ] Have, [ ___ ] have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
