LIMITED SOURCE JUSTIFICATION FOR FSS ORDER
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: This is a Limited Source Justification.
The requiring activity is the Comprehensive Industrial Hygiene Laboratory (CIHL) Detachment San Diego;
the contracting activity is Naval Medical Logistics Command.
2. NATURE/DESCRIPTION OF CONTRACT ACTION: This acquisition is conducted under the authority of the Multiple Award Schedule Program (Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.) and Title 40 U.S.C. 501, Services for Executive Agencies). This is a brand name only limited source action to be awarded as a new Federal Supply Schedule order. The placement of a firm fixed price order is anticipated.
3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed acquisition is for one (1) inductively coupled plasma mass spectrometer (ICP-MS) manufactured by Agilent Technologies, Inc. 6850 Centerville Road, Wilmington, DE 19898 for use at the Comprehensive Industrial Hygiene Laboratory (CIHL) Detachment San Diego, CA. The system shall be capable performing National Institute of Occupational Safety and Health (NIOSH) and Occupational Safety and Health Administration (OSHA) testing to ensure workplace safety. The system shall be capable of detecting and quantifying numerous metals simultaneously in Mixed Cellulose Ester Filters (MCEF), Ghost Wipes, and Bulk samples. The system shall be capable of accurately and precisely detecting and quantifying different metals simultaneously including but not limited to Beryllium, Cadmium, Mercury, and Lead in the single digit parts per billion range. The system shall be capable of operating in helium collision mode with Kinetic Energy Discrimination (KED). The system shall have an open access sample introduction chamber with a sample aerosol nebulizer. The system shall be capable of accommodating high matrix samples containing 15 – 25% dissolved solids. The system shall be capable of accommodating highly acidic sample introduction. The system should have automated sample dilution. The system shall include a recirculating water chiller and random access autosampler. The system shall be benchtop with a maximum width of 63 inches and a maximum depth of 24 inches. The system shall include all hardware, software, licensing, and startup consumables to enable full system functionality. The system shall be compatible with the currently installed laboratory information management system, Sample Master v8.5. Instrument installation, onsite familiarization and operator training are required. The power requirement is 120/220VAC, 60Hz.
Vendor shall be an Original Equipment Manufacturer (OEM) authorized maintenance contractor for the proposed equipment/systems such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.
Navy Defense Health Program (DHP) Operations and Maintenance (O&M) funds in the amount of $180,868.09 will be used to procure the ICP-MS System.
4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-6(b), Item peculiar to one manufacturer is 41 U.S.C. 251, as implemented by FAR 8.405-6.
The proposed requirement is to acquire an Agilent ICP-MS system, a brand name item available on various schedule contracts peculiar to one manufacturer. Only the ICP-MS systems manufactured by Agilent Technologies is capable of accommodating high matrix samples containing 15 – 25% dissolved solids. No other manufacturer is capable of providing an ICP-MS system capable of accommodating high matrix samples containing 15 – 25% dissolved solids. Samples obtained by bulk and wipe collection techniques typically contain a high proportion of solids. Other instruments, which can only accommodate up to 4% dissolved solids, necessitate extensive sample manipulation and dilution which reduces analysis sensitivity and increases the likelihood of error by an order of magnitude compared to an instrument which can accommodate up to 25% dissolved solids. If analysis results are not accurate and precise, then hazardous workplace conditions may not be properly identified, putting Navy personnel at otherwise-avoidable health risk. Agilent Technologies, Inc. is the only manufacturer which meets the minimum requirements.
5. DETERMINATION OF THE BEST VALUE: GSA has determined the prices of the schedule contracts to be fair and reasonable for the purpose of establishing the schedule contract. Therefore, ordering activities are responsible to make a separate determination of fair and reasonable pricing for individual orders. The Naval Medical Logistics Command Contracting Officer will determine, using the procedures in FAR 15.404-1 that the prices are fair and reasonable and will document such determination with a level of detail commensurate with the complexity and circumstances of each order.
6. DESCRIPTION OF MARKET RESEARCH: Market research was conducted in November 2015. The market research conducted included research conducted by the internet, review of product literature, and consultation with CIHL San Diego. The internet search was done using Google, Bing, and GSA Advantage. It was found that Agilent Technologies, Inc. is the only manufacturer which can provide an ICP-MS system which meets the minimum requirements. Only the ICP-MS systems manufactured by Agilent are capable of accommodating high matrix samples containing 15 – 25% dissolved solids. Other manufacturers such as Thermo Scientific, PerkinElmer, Nu Instruments, Analytik Jena, GBC Scientific Equipment, and Spectro Analytical Instruments also provide ICP-MS systems, but those systems are not capable of accommodating high matrix samples containing 15 – 25% dissolved solids. Several of the other manufacturers advertise high matrix tolerance capability, but they are only capable of accommodating samples containing up to approximately 4% dissolved solids. No other manufacturer besides Agilent Technologies, Inc. can provide an ICP-MS system capable of accommodating high matrix samples containing 15 – 25% dissolved solids. Agilent Technologies, Inc. is the only manufacturer which meets the minimum requirements. Market Research indicates the ICP-MS System is available from other vendors on GSA/FSS including Agilent Technologies, Tevet, LLC and Technical Communities. The requiring activity certifies that the requirement can be met by a commercial item and provides supporting documentation which is provided in the contract file.
7. ANY OTHER SUPPORTING FACTS: This procurement uses a GSA Schedule and will be solicited and awarded in accordance with FAR Subpart 8.4.
Previous Procurements of these items:
N626454-10-F-0141, Agilent Technologies, Inc., awarded on 08 July 2010, in the amount of $171,016.24 as the only responsible source capable of meeting the Governments requirement.
8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: As the barriers that preclude the agency from the requirements of section 8.405-1 (SUPPLIES) are due to limited vendors on schedule, no actions can be taken by this agency to remove those barriers. If additional vendors are added to the FSS for this equipment, they will be considered as applicable. All future requirements will be handled on a case-by-case basis
