JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

This Justification and Approval (J&A) is executed by the Naval Medical Logistics Command (NMLC), 693 Neiman Street, Fort Detrick, MD 21702, on behalf of the requesting agency, Naval Medical Research Unit San Antonio (NAMRU-SA), 3650 Chambers Pass, Building 3610, JBSA Fort Sam Houston, TX 78234.

2. Description of the Action Being Approved.

Award of a contract on a sole source basis will be made to provide an indefinite-delivery indefinite-quantity contract to IDEXX Laboratories for disposable consumables, reagents, and supplies for a base period of 12 months, followed by four 12-month option periods for a total of 60 months; deliveries to be scheduled at designated locations on an “as needed” basis. The proposed source is IDEXX Laboratories (One IDEXX Drive, Westbrook, ME 04092).

3. Description of Supplies/Services.

The requirement is for an indefinite-delivery indefinite-quantity contract to provide the delivery of disposable consumables, reagents, and supplies up to 250 boxes (12 clips/box) Catalyst Chem 17 Clips, 250 boxes (12 slides/box) Catalyst aspartate aminotransferase (AST), 200 boxes (12 slides/box) Catalyst Magnesium, 200 boxes (12 slides/box) of Catalyst Creatine Kinase (CK), 200 boxes (12 slides/box) Catalyst Lactate (LAC), 200 boxes (12 slides/box) Catalyst Lactate Hydrogenase (LDH), 20 boxes (6 clips/box) Catalyst QC Clips, 20 VetTrol control boxes (4 sets/box), 80 boxes (40 separators/box) Catalyst Lithium Heparin Whole Blood Separators, 80 boxes (40 separators/box) of Catalyst Whole Blood Separators, 100 Catalyst Pipette Tip Boxes (500 tips/box), 100 Catalyst Sample Cup Boxes (450 cups/box), 25 Procyte DX Reagent Kits, 25 Procyte Dx Stain Packs, 100 boxes (50 tubes/box) VetCollect Tubes, 25 e-Check controls, and 25 bottles of HydroClean.

The IDIQ contract will be for a base ordering period of 12 months with four 12 month options for a total ordering period (if the Government exercises all options) of 60 months. The maximum order threshold is estimated to be $186,856.00 for each year. The maximum ordering threshold for the 60 month period is $934,280.00.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory exception permitting other than full and open competition for this acquisition is 10 USC 2304(c)(1) and FAR 13.501(a), sole source acquisitions.

5. Rationale Justifying Use of Cited Statutory Authority.

The reason for justification of use of the cited statutory authority is ongoing studies that will performed at NAMRU-SA utilizes the IDEXX Catalyst One Chemistry Analyzer and the Procyte Dx Hematology/CBC analyzer that are currently installed at Tri-Services Research Laboratory.

The Catalyst One provides a comprehensive chemistry profile from blood samples of up to 30 analytes that include: albumin, globulin, amylase, cholesterol, glucose, creatinine, phosphate, calcium, BUN, total bilirubin, and total protein. The Procyte Dx delivers a five-part white blood cell differential (e.g. monocytes, lymphocytes, neutrophils, eosinophils, and basophils) and absolute cell counts to provide 26 whole-blood parameters to include: hematocrit, hemoglobin, platelet count, and red blood cell count. Analyses of these hematological parameters and profiles are limited to these pieces of equipment in NAMRU-SA’s hematology laboratory and therefore require the proper reagents, consumables, and supplies to correctly operate the equipment.

IDEXX is the OEM manufacturer for the IDEXX Catalyst One Chemistry Analyzer and the IDEXX Procyte Dx Hematology analyzer The OEM manufacturer (IDEXX) is the sole supplier of IDEXX disposable consumables, reagents, and supplies.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market research was conducted in September and October of 2015. The market research conducted included research conducted by review of product literature, and email communication with potential vendors. Three known reagent companies were contacted (Fisher Scientific, VWR and IDEXX). Fisher Scientific and VWR provided responses that stated that they do not manufacture reagents compatible with the IDEXX Catalyst One Chemistry Analyzer and IDEXX Procyte Dx analyzers. The OEM manufacturer (IDEXX) is the sole manufacturer and supplier of IDEXX disposable consumables, reagents, and supplies and therefore is the is the only company that can meet the Governments requirement.

A sources sought notice was posted on 24 March 2016 with a closing date of 31 March 2016. No responses were received in response to this notice.

A notice of intent was posted on 31 March 2016 with a closing date of 14 April 2016. No responses were received in response to this notice.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer shall determine that the anticipated cost to the Government of the supplies covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the vendor’s commercial price list and will be determined fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, the Naval Medical Logistics Command has no plans at this time to compete future contracts for the types of supplies/services covered by this document.

If another potential source emerges, the Naval Medical Logistics Command will assess whether competition for future requirements is feasible.

9. Contracting Point of Contact.

The point of contact at Naval Medical Logistics Command is Amanda E. Rutten, Code 05, at DSN 343-3969, commercial (301) 619-3969 or by e-mail at Amanda.E.Rutten.civ@mail.mil.
