2. Nature and/or Description of Contract Action Being Approved: This acquisition is conducted under the authority of the Multiple Award Schedule Program (Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.) and Title 40 U.S.C. 501, Services for Executive Agencies). This is a limited source action to be awarded as a new FSS order under GS35F-0375L, to HGW and Associates, LLC, 9000 Executive Park Drive, Suite C-150, Knoxville, TN 37923, for Enterprise Safety Applications Management System (ESAMS) continued programmatic support and licenses. ESAMS is a comprehensive enterprise wide multi-functional safety management system consisting of multiple safety operation modules supporting all aspects of the Navy’s Safety and Occupational Health (SOH) Program. ESAMS is currently used by Navy Medicine as the exclusive data management system for motorcycle safety and to achieve compliance with the OPNAVINST 5100.23G directive for communicating medical surveillance results; occupational injury and illness treatment and qualification assessments to safely don respirators;
and, tracking medical surveillance follow-up requirements. Navy Medicine also utilizes the ESAMS medical surveillance module to track the health of 60,000 plus Navy and Marine Corps personnel. In addition, ESAMS recordkeeping and monitoring functionality allows Navy Medicine to comply with Navy Audit Service reporting requirements to the Chief of Naval Operations (CNO) and Chief of the Marine Corps (CMC). ESAMS is accessed via a Navy Medicine web portal to the ESAMS web application.
4. The Authority and Supporting Rational and, if applicable, a Demonstration of the Proposed Contract’s Unique Qualifications to Provide the Required Supply or Services: The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-2 is 41 U.S.C. 251, as implemented by FAR 8.405-6(a)(1)(i)(B), Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
This requirement is for continued programmatic support and licenses for the ESAMS throughout Navy Medicine that is compatible with the existing Navy Medicine web portal to the ESAMS web application. ESAMS is a proprietary product that is developed, distributed and marketed solely by HGW and Associates, LLC. Only HGW and Associates, LLC has the proprietary knowledge to provide continued ESAMS programmatic support and licenses. Additionally, HGW and Associates, LLC is a vendor on the Federal Supply Schedule (FSS).
5. A Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value Consistent with 8.404(d): The General Services Administration (GSA) has determined the prices of services under the schedule contracts to be fair and reasonable for the purpose of establishing the schedule contract. Therefore, ordering activities are responsible to make a separate determination of fair and reasonable pricing for individual orders. The Contracting Officer will determine, using the procedures in FAR 15.404-1, that the prices are fair and reasonable and will document such determination with a level of detail commensurate with the complexity and circumstances of each order within the contract file.
