LIMITED SOURCE JUSTIFICATION

1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY: This is a Limited Source Justification. This justification is executed by the Naval Medical Logistics Command (NMLC), acting on behalf of Navy Medicine, to meet the requirements of the Navy Medicine Military Treatment Facilities (MTFs).

2. NATURE/DESCRIPTION OF CONTRACT ACTION: The proposed action is to modify a firm-fixed price delivery order to extend the performance period by six (6) months for Program Management, System Customization & Data Analysis, and Additional Days Extended (Staff Days Onsite) services; exercise the CLINs associated with Program Management, System Customization & Data Analysis, and Additional Days Extended (Staff Days Onsite) services; increase the total cost for System Customization & Data Analysis; and, add funding to support the additional services.

3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: Navy Medicine has a requirement for a software upgrade on the Patient Queuing & Notification System (PQNS). The software upgrade shall be compatible with the existing Q- Flow equipment currently installed at the requiring Navy Medical Treatment Facilities. The software upgrade for the Q-Flow system shall bring all sites onto the PQNS v5.8 platform. Sites to include: NH Pensacola, NH Rota, NH Cherry Point, NH Guam, NH Pearl Harbor, NHC Fallon, NH Twenty Nine Palms, NAS Belle Chase, NH Beaufort, NH Jacksonville, NH Oak Harbor, NH Okinawa, NMC Portsmouth, NH Yokosuka, NAS Lemoore, NH Camp Pendleton, and NH Guantanamo. The software upgrade shall include training and installation. The requirement shall include travel and operator training charges.

Vendor shall be an Original Equipment Manufacturer (OEM) authorized maintenance contractor for the proposed equipment/systems such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.

The modification will extend the performance period by six (6) months for Program Management, System Customization & Data Analysis, and Additional Days Extended (Staff Days Onsite) services; exercise CLINs 1001, 1002 and 1003; increase the total cost of CLIN 1002 – System Customization & Data Analysis and add funding to support the additional services. Each MTF required custom coding to bring all sites onto the PQNS v5.8 platform;

however, various sites are more complex and require a higher level of coding than the Government originally anticipated. As a result, the software upgrade across Navy Medicine requires additional time and resources to complete.

4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in 8.405-1 is 41 U.S.C. 251, as implemented by FAR 8.405-(6)(b)(1) Only one source is capable of responding.

ACF Technologies is the only vendor capable of providing the software upgrade to the proprietary Q-Flow software installed at all existing users within Navy Medical Treatment Facilities. The Q-Flow software upgrade will ensure the Patient Queuing & Notification System remains fully functional. No other manufacturer is capable of providing upgrades to proprietary Q-Flow software. ACF Technologies is the only vendor which meets the minimum requirements and is on the Federal Supply Schedule.

5. DETERMINATION OF BEST VALUE: In accordance with FAR 8.404(d), Pricing (DEVIATION), GSA has determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, to be fair and reasonable for the purpose of establishing the schedule contract. GSA’s determination does not relieve the

Form 02.4G.AA/N62645-15-F-1085 Page 2 of 3 01 December 2014 ordering activity contracting officer from the responsibility of making a determination of fair and reasonable pricing for individual orders, BPAs, and orders under BPAs, using the proposal analysis techniques at FAR 15.404-1.

Therefore, ordering activities are responsible for making a separate determination of fair and reasonable pricing for individual orders. The Contracting Officer will determine, using the procedures in FAR 15.404-1, that the prices are fair and reasonable and will document such determination with a level of detail commensurate with the complexity and circumstances of each order. The Contracting Officer may also seek additional discounts before placing the order.

6. DESCRIPTION OF MARKET RESEARCH: Market research was conducted and included a search of the Internet using Google, Bing, GSA Advantage, and the ECRI Sourcebook. Various vendors are able to provide pharmacy systems and upgrades to those systems, but only ACF Technologies can provide proprietary hardware and software upgrades to their own equipment. Only a system upgrade from ACF Technologies would be able to provide the necessary proprietary software and hardware upgrades specific to the installed equipment. No source other than ACF Technologies can meet the minimum requirements of the Government. It should be also noted that the upgrade being procured is not required under an existing government contract.

7. ANY OTHER SUPPORTING FACTS: This procurement uses a FSS and will be solicited and awarded in accordance with FAR Subpart 8.4.

8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: All future requirements will be handled on a case-by-case basis. As the barriers that preclude the agency from the requirements of section 8.405-1 (SUPPLIES) are due to limited vendors on schedule, no actions can be taken by this agency to remove those barriers. If additional vendors are added to the FSS for this equipment, they will be considered as applicable.
