J&A No. 19-033

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

Authority: 41. U.S.C. 1901(e)(2), as implemented by FAR 13.106-1(b)

Pursuant to the Competition in Contracting Act (CICA) and in accordance with FAR 6.303-1 Requirements and FAR 6.303-2 Content, this justification shall incorporate sufficient facts and rationale to support the use of the statutory authority cited.

1. Contracting Activity.

This is a Justification for Other Than Full and Open Competition to procure gym memberships for active duty personnel to be executed by Naval Oceanographic Office (NAVOCEANO) Contracts Department. NAVOCEANO proposes to enter into a contract with Syncom Space Services, LLC (S3).

2. Description of the Action Being Approved.

Annual fitness center memberships are being procured for military personnel to meet the Navy standards in physical fitness. The Physical Readiness Training provides Commanding Officers (COs) with a means of assessing the general fitness of members of their command and provides a means to comply with DODI (Department of Defense Instruction) 1308.3 to develop and administer a physical fitness test that evaluates aerobic capacity, or cardio-respiratory endurance, and muscular strength, and muscular endurance.

3. Description of Supplies/Services.

This action is for access to SSC Wellness center for Navy military personnel stationed at Stennis Space Center, MS. The proposed action will consist of one (1) base year with four (4) one (1) year option periods.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority for this requirement is FAR 41. U.S.C. 1901(e)(2) as implemented by FAR 13.106-1(b)(1)(i) - only one source reasonably available.

5. Rationale Justifying Use of Cited Statutory Authority.

NASA provides the fitness facility at Stennis Space Center, MS. Military members are required to maintain minimum body fat standards and physical training assessments twice per year. The SSC Wellness Center is the only location at Stennis Space Center. Other gyms are too far away and there is not enough time for personnel to travel to and from during workdays.

FOR OFFICIAL USE ONLY

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Other fitness centers require travel and additional time for military members to exercise.

7. Determination of Fair and Reasonable Cost.

Before making an award, the Contracting Officer will determine that the proposed price is fair and reasonable based on one of the techniques identified in Federal Acquisition Regulation (FAR) Subpart 13.106-3 - Award and Documentation.

8. Actions to Remove Barriers to Future Competition.

At this time NAVOCEANO has no intent to compete this requirement; however, recurring market research will continue to be conducted throughout the lifecycle to examine suitability of emerging business locations. If a new gym location is capable and compatible, full and open competition will be sought to maximum extent possible.
