JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
Authority: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1
Pursuant to the Competition in Contracting Act (CICA) and in accordance with FAR 6.303-1 Requirements and FAR 6.303-2 Content, the justification shall incorporate sufficient facts and rationale to support the use of the statutory authority cited.
1. Contracting Activity.
This is a justification for Other Than Full and Open competition to procure software maintenance for existing SonarWiz licenses to be executed by the Naval Oceanographic Office (NAVOCEANO) Contracts Department.
2. Description of the Action Being Approved.
The Government anticipates awarding a firm fixed price purchase order on a sole source basis for SonarWiz Software Maintenance.
3. Description of Supplies/Services.
The proposed order is to procure software maintenance for continued support for existing Chesapeake Technology SonarWiz software licenses (serial numbers: 1328, 1354, 1355, 1356, 1357, 1446, 1563, 1564, 1638, 1912, 1346, 1683, 1684, and 1920.)
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2403(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1.
5. Rationale Justifying Use of Cited Statutory Authority.
This acquisition covers license renewals, maintenance, and on-going support of FST’s existing SonarWiz software. Software support is term, thus requiring annual renewal for continued use and support. SECNAVINST 5230.15 requires software maintenance and support.
Substantial technical research and system testing has been conducted before selection of the installed software. Command personnel are trained and have developed specialized expertise working with SonarWiz software. FST has made a substantial investment of both software and
FOR OFFICIAL USE ONLY
personnel training to achieve the current state of operational capability and functionality.
Continued support must come from the developer Chesapeake Technology, Inc. (Chesapeake) Selection of new software type would provide no demonstrable value, would cause unacceptable delays in sustaining and improving the agency’s critical operations, and would cost an estimated $150K for the initial start-up with one year of maintenance to include training. Maintaining the existing infrastructure is in the best interest of the Government.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted via the internet and contact with Chesapeake, for the purpose of identifying distributor or authorized resellers for SonarWiz support.
Market research demonstrated that Chesapeake has several distributors located in the United States. Product is not available on SEWP nor GSA.
7. Determination of Fair and Reasonable Cost.
Before making award, the Contracting Officer will determine that the proposed price is fair and reasonable based on one of the techniques identified in Federal Acquisition Regulation (FAR) Subpart 13.106-3.
8. Actions to Remove Barriers to Future Competition.
NAVOCEANO has not intent of competing this requirement full and open however, prior to award of future contracts, for the same or similar item, market research will be completed to determine if potential sources have emerged that will allow for competition.
