4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c) (1), Only One Responsible Source and No Other Supplies or Services Will
Satisfy Agency Requirements as implemented by FAR 6.302-1.
5. Rationale Justifying Use of Cited Statutory Authority.
The MACO gliders being purchased from SPAWAR are commercial proprietary systems built by Teledyne. As such, the replacement parts are only available from Teledyne Webb Marine who manufactures the gliders. All glider parts are manufactured to proprietary specifications required of the gliders to perform successfully within the ocean environment. There are no after-market parts available that can meet the Teledyne Glider specifications since the specifications are not publicly known and the extreme environmental conditions the gliders operate in would cause risk to the glider survivability and operations if ad-hoc parts are used to refurbish the
MACOS Gliders. Operational failures would be of great impact to data collection used for
Theater Anti-Submarine (TASW) which require the glider data collected for models used as input to TASW tactical decision aids (TDAs). Inaccurate TDA data could result in diminished ability to find and track adversarial undersea operations.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
This equipment is the sole proprietary property of Teledyne. They are not available from any other vendors through resale or other means.
7. Determination of Fair and Reasonable Cost.
Before making an award, the Contracting Officer will determine that the proposed price is fair and reasonable based on one of the techniques identified in Federal Acquisition Regulation
(FAR) Subpart 13.106-3 - Award and Documentation.
8. Actions to Remove Barriers to Future Competition.
Prior to the award of future contracts, market research will be completed to determine if potential sources have emerged that will allow for competition.
