About this file

This is a Limited Source Justification for a brand name acquisition by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD).

NSWC PCD is acquiring 100 units of Ocean Technology Systems SDV MK8 Headset – AGA Masks (part number 900502-006, previously 910274-001) on a firm fixed price basis through simplified acquisition procedures. The total contract value exceeds micro-purchase levels but does not exceed the simplified acquisition threshold. The justification cites FAR 6.302-1(a)(2)(iii)(C), establishing that Ocean Technology Systems is the only responsible source capable of meeting the Government's needs because the headsets must be compatible with the existing SDV MK8 system. Purchasing alternative brands would create unacceptable risk to project timelines and incur additional costs. Ocean Technology Systems is identified as the original equipment manufacturer and only approved source of supply per approved Engineering Drawing 7648324, Rev. F. The Contracting Officer has determined the order represents best value and results in the lowest overall cost alternative when considering price, recurring costs, special features, and administrative costs. The purchase will be synopsized on sam.gov, and no additional market research was conducted given the single-source justification. No subsequent acquisition actions are anticipated to remove barriers to restricted consideration, as Ocean Technology Systems remains the only brand capable of meeting this requirement.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(C).

Pursuant to FAR 6.302-1(a)(2)(iii(C), Ocean Technology Systems is the only brand of equipment that will meet the Government’s needs for the following reasons. NSWC PCD currently has a need for Ocean Technology Systems 900502-006 SDV MK8 Headset – AGA Masks as referenced in Section 2 of this document. This Headset – AGA Mask will be used with the existing SDV MK8 system. If another brand Headset – AGA Mask were to be purchased, it may not work with the existing SDV MK8 system, resulting in unacceptable risk to the project timeline and additional cost to the Government. Ocean Technology Systems is the OEM and the only approved source of supply for the items listed in Section 3 per the attached approved Engineering Drawing 7648324, Rev. F.

As such, the government does not expect significant savings through competition, and it is more advantageous to the Government to purchase the Ocean Technology Systems headsets listed in Section 2 of this memo.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, recurring cost, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

This purchase will be synopsized on the Contract Opportunities website at sam.gov. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Ocean Technology Systems to provide the products.

7. Any other facts supporting the justification. None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Ocean Technology Systems is the only brand that can meet this requirement.
