About this file

This document is a Sole Source Memorandum from the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) justifying a direct award to Innovative Professional Solutions (IPS) for repair services. The procurement involves assembling four complete sensors and repairing three failed sound arrays for the AN/SSN-2V(5) Precise Integrated Navigation System (PINS) Acoustic Doppler Current Profiler (ADCP) used on Avenger MCM ships. The contract will be a firm fixed-price purchase order under the WOSB Statute, with a total value not exceeding $250,000.00 and all services to be completed within 30 days of receipt from the government.

The sole source justification is based on IPS being the only contractor with personnel who originally installed these ADCPs in the mid-1990s and possess in-house knowledge of the system's watertight design. With the MCM ships scheduled for decommissioning in the next three years, the government determined that developing a new ADCP solution would be prohibitively costly and time-consuming. The contracting officer has determined that this award represents the best value and lowest overall cost alternative, and the requirement will be synopsized on SAM.gov.

MEMORANDUM

Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE PRECISED INTEGRATED NAVIGATION SYSTEM

(PINS) ACOUSTIC DOPPLER CURRENT PROFILER (ADCP REPAIR FROM INNOVATIVE

PROFESSIONAL SOLUTIONS (IPS)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order, under the WOSB Statue FAR 19.1506, to Innovative Professional Solutions (IPS) to provide repair services for the AN/SSN-2V(5) Precise Integrated Navigation System (PINS) project. The PINS project has a sensor to navigate in GPS deprived environment and to measure water current around the ship. The heart of the system is a special nonmagnetic, low Electro Magnetic Interference (EMI), and 901D shock approved Acoustic Doppler Current Profiler (ADCP) for the Avenger MCM ship. The ADCPS were installed over 25+ years ago. The original equipment manufacturer (OEM) no longer supports our current ADCP design. Contractor support is required to repair ADCPs that were received from NAVSUP.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

Contractor support is required to assemble four (4) complete sensors using government furnished sound arrays and housings. This effort also includes the repair three (3) failed sound arrays. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. All services will be completed no later than thirty (30) days after receipt from the Government.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C.

2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).

This procurement is sole source for the following reasons. IPS in the only source that has the personnel that installed these ADCP, serviced them on the ship, and have the knowledge of the inner working of these devices.

IPS’s personnel installed the ADCPs in mid-1990. IPS is the only known contractor that has staff that has the in-house resident knowledge of the watertight design of the ADCPs. The MCMs are scheduled to decommission in the next 3 years. Currently the Government owns the basic interconnect diagrams and requirements of what the ADCPs The additional costs and investment of time for a new ADCP solution meeting the strict requirement environment of a MCM are both cost and time prohibitive. As such, the Government does not expect significant savings through competition and does expects significant and unacceptable delays that will negatively impact this requirement.

Therefore, it is in the Governments’ best interest to award on a sole source basis to IPS, Incorporated.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, IPS Incorporated is the only source that can meet the Government’s needs. This requirement will be synopsized in the government point of entry site SAM.gov.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, IPS Inc. is the only source that can meet this requirement.
