About this file

This is a Brand Name Justification document from the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) for the acquisition of a Lunaire Steady State Chamber (model CEO-932-4-B-F4T-ETO). The procurement will be conducted using simplified acquisition procedures with a total estimated value between $25,000 and $250,000.

The 32 cu.ft. chamber includes heat, refrigeration and humidity controls, Watlow F4T Controller, and specific requirements including -5°C operation capability, 4" stainless steel access ports, and humidity range of 20-95% over 20°C to 85°C. The justification cites that only the Lunaire brand can meet requirements as it is compatible with existing hardware and software control systems at the Navy Experimental Diving Unit (NEDU). The chamber will be used for testing diver's life support equipment, requiring stringent temperature and humidity control. The requirement will be synopsized on sam.gov due to the value exceeding $25,000. The order includes two replacement demineralizer cartridges and shipping to NEDU in Panama City, FL.

This acquisition will be conducted using simplified acquisition procedures with a total estimated value greater than $25,000. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00.. Funding is to support procurement of equipment for upgrading hyperbaric test equipment, facilities atmospheric control, life support and physiological systems.

4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c)(1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1(c).

This equipment is being acquired as part of the hyperbaric test equipment support system for N31 Department at NEDU. This Lunaire steady state chamber with the custom capability specified is required to maintain stringent temperature and humidity requirements for testing of diver’s life support equipment. As a critical piece to the certification of diver’s life support equipment, the Lunaire steady state cabinet requested is the ONLY equipment that provides the necessary functions and is compatible with the current installed hardware and software control systems. In summary, using alternate equipment would prove costly in time and dollars to the government and to the mission. Use of another system may change or introduce new parameters that may be harmful to all diving systems tested and maintained at NEDU.

As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.

Therefore, it is in the Governments’ best interest to acquire the Lunaire brand.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Lunaire is the only brand that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov because it is estimated greater than $25,000.00.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Lunaire is the only brand that can meet the Government’s needs.
