About this file

This document is a Brand Name Justification to procure modified Jetway and Industrial Computers, Inc. embedded computers for the Naval Surface Warfare Center Panama City Division (NSWC PCD). The contracting activity is issuing a firm-fixed price contract to acquire 6 modified Jetway HBJC903I05-6412 computers and 15 modified Jetway HBFBZI0-6412 computers along with related components. The justification cites that the Jetway brand is the only one that will work with the configuration-controlled Multi-Vehicle Communications system (MVCS) and the Industrial Computers, Inc. brand items have been tested and approved for use. The contracting officer has determined this order represents the best value to meet the government's needs. The acquisition will be conducted using simplified acquisition procedures not exceeding the $250,000 threshold. The related federal contract opportunity is a small business set-aside solicitation for the same embedded computer builds.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).

The Naval Surface Warfare Center Panama City Division (NSWC PCD) currently has a requirement for the item(s) listed in Paragraph 3 of this document. The Multi-Vehicle Communications system (MVCS) Technical Direction Agent (TDA) has a requirement for the embedded computers and items listed in Paragraph 3 of this document for the purpose of providing network management and routing capabilities to our customers in a small form factor.

The Jetway brand computer is the only brand that will work as they are currently in use in a configuration-controlled system. In addition, the Industrial Computers, Inc. brand items have been tested and approved for use with the modified Jetway brand computer. Project delays and cost over-runs would occur if different brands were selected as they would have to be tested and approved, as well as drawings modified..

As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.

Therefore, it is in the Governments’ best interest to acquire the Jetway and Industrial Computers, Inc. brands.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Jetway and Industrial Computers, Inc. brands are the only brands that can meet the Government’s needs. (Redacted)

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Jetway and Industrial Computers, Inc. brands are the only brands that can meet this requirement.
