About this file

This justification and approval document seeks to award a sole source commercial item firm fixed price indefinite delivery, indefinite quantity contract to Raider Outboards Inc. for the inspection, repair, and refurbishment of approximately 250 Raider brand small outboard motors owned by the Department of the Navy supporting units located in the continental United States and Hawaii. The Naval Surface Warfare Center Panama City Division determined Raider to be the only responsible source that can diagnose, maintain, repair, and refurbish the current Raider motors in operation for the Navy due to Raider not utilizing distributors or maintaining independent service providers. The contracting officer found the anticipated prices to the government to be fair and reasonable, and no barriers to future competition were identified since no other potential sources for these services currently exist.

CONTROLLED UNCLASSIFIED INFORMATION (CUI) 2

5. Rationale Justifying Use of Cited Statutory Authority

NSWC PCD Maritime Mission Systems Division, Code E10 has a requirement to continue supporting the DoN units located CONUS and Hawaii for the inspection, repair and refurbishment of an estimated OBM owned by the DoN supporting various units using vessels located in the aforementioned locations. This proposed contract action is a follow-on to contract number N61331-19-D-0004, which was awarded on a sole source basis to Raider on 29 March 2019.

Raider does not utilize distributors nor maintains a network of independent service providers.

This makes the Raider the only source that can diagnose, maintain, repair, and/or refurbish the current motors in operation owned by the DoN.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

A sources sought notice was posted in the Government Point of Entry sam.gov from 1 September 2023 to 18 September 2023, per DFARS PGI 206.302-1(d). No other sources besides Raider Outboards Inc. responded or expressed an interest in this proposed contract action. In addition, a synopsis was published in sam.gov from 19 September 2023 to 4 October 2023, expressing the Navy’s intent to sole source the award to Raider. No other companies expressed interest. No additional market research was conducted because it is not practicable, for the reasons discussed

CONTROLLED UNCLASSIFIED INFORMATION (CUI) 3

in paragraph 5 above, for any company other than Raider to provide the required diagnosis, maintenance, repair, and/or refurbishment services.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated prices to the Government for the supplies/services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in paragraph 5, NSWC PCD has no plans at this time to compete future contracts for the type of supplies and services covered by this document. If another potential source emerges, NSWC PCD will assess whether competition for future requirements is feasible.

As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior J&A was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
