MEMORANDUM
Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE SLIP RING REFURBISHMENT SUPPORT FOCAL TECHNOLOGIES CORP (Purchase Request 1300817891)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”
This is a sole source justification. Contracting activity is NSWC PCD, Code 024, 110 Vernon Avenue, Panama City, FL, 32407.
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order to Focal Technologies Corporation, 77 Frazee Avenue, Dartmouth, Nova Scotia, Canada, B3B 1Z4, on a sole source basis, for the acquisition of electro-optical slip ring assemblies refurbishment support.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
This procurement is for the acquisition of contractor support to refurbish a slip ring assembly, model 173/156 in accordance with drawing number 103447-00 to return the slip ring to proper operation. The slip ring assembly consists of fiber optic rotary joint, electrical slip ring, and a fluid rotary union. The refurbishment will consist of replacement of rings, brushes, wires, fiber optic components, bearing, gears and seals, damaged torque arm, FRU shaft and seal separators.
This acquisition will be conducted using simplified acquisition procedures with a total estimated value of $43,192. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This procurement is funded with FY19 Operation and Maintenance Navy (OMN) Funds.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).
This acquisition is unsuitable for full and open competition for the following reasons.
a. Focal Technologies Corporation is the sole manufacturer of the electro-optical slip ring assemblies. A slip ring is an electromechanical device that allows the transmission of power and electrical signals from a stationary to a rotating structure. Also called a rotary electrical joint, collector or electric swivel, a slip ring can be used in any electromechanical system that requires unrestrained, intermittent or continuous rotation while transmitting power and / or data. It can improve mechanical performance, simplify system operation and eliminate damage-prone wires dangling from movable joints.
b. Focal Technologies specializes in providing custom electrical slip ring, fiber optic, fluid swivel and optical multiplexer solutions. Fiber Optic Rotary Joints (FORJs) are to optical signals what electrical slip rings are to electrical signals, a means to pass signals across rotating interfaces, particularly when transmitting large amounts of data. Focal Technologies is the only company that has the in-house resident knowledge that can refurbish the slip ring to maintain the intrinsic advantages of fiber end to end. Focal Technologies has been producing Fiber Optic Rotary Joints for over twenty years.
c. Moog's fluid rotary unions are currently used to ensure reliable transmission of life support, process, power and control fluids. Focal Technologies is the only company that has fluid rotary unions rated for pressures up to 15,000 PSI (1000 bar). Seals are selected based on chemical compatibility, design pressure, design temperature, required service life and acceptable leakage rate. Leak collection can be supplied when required for environmental or personnel safety. These are the only fluid rotary unions that can be combined with the current electrical slip rings and fiber optic rotary joints.
In summary, use of any other vendor would result in substantial duplication of cost.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Focal Technologies is the only source that can meet the Government’s needs.
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
For the reasons specified in paragraph 4 above, Focal Technologies is the only source that can meet the Government’s needs.
