CLASS JUSTIFICATION AND APPROVAL (CJ&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Ave e, Panama City, FL 32407-7001, Contracts Department, Code .
2. Description of the Action Being Approved
Award to the University of Michigan (UM), 500 S State St, Ann Arbor, MI 48109, (CAGE code: 03399) on a sole-source basis, for research and development services to model propeller occlusion of Polymer Kelp (PK) variants against outboard motors, and to characterize material responses to environmental conditions for Maritime Vessel Stopping Occlusion Technologies (MVSOT).
Authority to act under this CJ&A expires on 1 October 2023.
3. Description of Supplies/Services
UM will provide research and development services to model, test, qualify, and report the characterizations of propeller occlusion with PK. Specifically, utilizing FY19 tow tank testing results UM will model PK interaction with a mission-relevant hull. Two levels of fidelity will be used including high fidelity computational fluid dynamics (CFD) and lower fidelity analytic modeling while using data gathered in FY19 for validation. Two follow-on options are included, based on the results from the initial effort and funding availability; these options include further assessment of the developed occlusion
J&A Number 119002 models, tow and wind tank validation, and testing against PK variants, including novel bio-inspired materials developed by the MVSOT team. NSWC PCD intends t ltiple contract actions for an estimated value of using Fiscal Year (FY) 2019 through 2022 Research, D , Test & Evaluation (RDTE) funding as shown in the table below. The certifying technical and requirements personnel verified the Government’s minimum needs.

4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.
5. Rationale Justifying Use of Cited Statutory Authority
This procurement is sole source for the following reasons.
a. Pursuant to 10 U.S.C. 2304(c)(1), UM is the only responsible source capable of providing the required material in the required schedule and quantities. The Navy has previously contracted occlusion modeling research and development support from the UM under contract FA8075-14-D- 0014. This effort is for the continued research and development support of the UM to further develop and refine specialized CFD propeller occlusion models based on MVSOT test materials.
b. For another contractor to develop the necessary knowledge, expertise and inherent technical data to develop these same models and capabilities along with the same level of accuracy would take several years at a minimum.
Additionally, the facilities (i.e., laboratory) and technical resources available to the UM to perform this type of specific modeling would cost the Government a minimum of $1,300,000. This figure is based on the historical costs of developing this specific capability at the UM given their existing hydrodynamic expertise in occlusion modeling, which is unique when compared to other hydrodynamic modeling groups. This cost is not expected to be recovered through competition if the original source is not utilized for this effort. In summary, no other known sources exist that can satisfy this requirement without unacceptable cost, schedule, and technical risk to the Government.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
The proposed contract was synopsized via posting on the Federal Business Opportunities (FedBizOpps) website on 30 July 2019 and no other potential source expressed an interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than the UM with this laboratory to provide the components and technical services.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable pursuant to FAR Part 15.4.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWC PCD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC PCD will assess whether competition for future requirements is feasible.
