The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $150,000.00. All equipment will be delivered no later than two (2) weeks after award of the order. The contract action will be funded with FY18 Ship Construction, Navy (SCN) and FY18 Operation & Maintenance, Navy (O&MN) funds.
4. Identification of the justification rationale. Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. 10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.
This material is being procured as an end of life buy from the Original Equipment Manufacturer.
NSWC PCD E31 Landing Craft Air Cushion (LCAC) Command, Control, Communications, Computers, & Navigation (C4N) has been tasked by Naval Sea Systems Command (NAVSEA) PMS-377 under TPS 18-LCAC-SCN-1-404 to purchase this material to support the Navy LCAC Program, Sensor Interface Units (SIU's) until craft end of life/deactivation. These items were specifically tested and evaluated against the NAVSEA technical requirements as provided on the LCAC C4N System specification during the product’s initial prototyping and evaluation phase. No other source for these interface boards currently exists. Comark Corporation is the only company that manufactures these Commercial off-the-shelf (COTS) items that will meet form, fit, function, and interchangeability requirements for the LCAC C4N system. Developing another source for these items would be cost and schedule prohibitive. NAVSEA has conducted a qualification program for manufacturers of LCAC Service Life Extension Program (SLEP) Sensor Interface Units (SIU) and their components and has determined that it is necessary to purchase the same units The SIUs described in this Sole Source are the only ones that have passed the NAVSEA qualification program.
The cost of conducting this qualification program on a new SIU design based on the Government’s specification is estimated at $519,900. This cost is based on a formal estimate developed by the LCAC C4N project to formally qualify a new SIU design based on a revised Government specification.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, reoccurring cost, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
This requirement will be synopsized via posting on the Federal Business Opportunities (FEDBIZOPPS) website with FAR 5.2. The synopsis expressed the Government’s intent to contract on a sole source basis. The synopsis provided instructions for offeror(s), wishing to qualify items for future procurements.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Comark Corporation is the only company that can meet the requirement
