SOURCE SELECTION INFORMATION - SEE FAR 2.101 and 3.104

J&A Number: 118011 Code: E31

P.R. #: TBD

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

2. Description of the Action Being Approved

Authorization to procure commercially available parts for the Landing Craft Air Cushion (LCAC), Command, Control, Communications, Computers, and Navigation (C4N) Systems project from a certified Hub Zone company United Electronics Industries (UEI) Services LLC, 8264 Sub Base Suite 3, St. Thomas, VI 00802 on the basis of other than full and open competition.

3. Description of Supplies/Services

This acquisition is for thirteen (13) commercially available CAMS I/O Units P/N that will be used in the LCAC C4N System Baseline Configuration 4 (SBC4) Control, Alarm, and Monitoring System (CAMS). The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The total estimated amount of this acquisition is $443,000.00. A firm-fixed-price commercial item order is anticipated using FY 2018 Ship Construction Navy (SCN) funds.

Delivery will be to NSWC PCD four (4) weeks after award of the contract or exercise of any option.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(5) - Authorized or Required by Statute, FAR 6.302-5(b)(5) Sole source awards under the HUBZone Act of 1997—15 U.S.C. 657a.

J&A Number: 118011

5. Rationale Justifying Use of Cited Statutory Authority

NSWC PCD is the design authority for the LCAC C4N systems. These systems are part of the Service Life Extension Program (SLEP).

The Amphibious Warfare Program Office PMS377 J-Division SLEP program of record is in the process of upgrading legacy craft.

Craft configured with System Baseline Configuration Two (SBC2) will be technology refreshed with System Baseline Configuration Four (SBC4). The parts requested in this memorandum are to be provided as Government Furnished Equipment (GFE) to an Alteration/Installation Team (AIT) for integration with SBC4 installation kits. The processors are commercial items manufactured by UEI Services LLC to replace the aging SBC2 Control, Alarm, and Monitoring System (CAMS) computers and Input/Output (I/O) devices that are now obsolete. This procurement is not suitable for full and open competition and it is in the best interest of the Government to acquire these items using a non-competitive procurement because UEI, as the Original Equipment Manufacturer (OEM), is the only company that makes this slightly modified commercial item that is compliant with the Government owned SBC4 Technical Data Package (TDP).

The items being procured were tested and evaluated against the Naval Sea Systems Command (NAVSEA) technical requirements as provided on the LCAC C4N System Baseline Configuration 4 (SBC4) product specification during the product’s initial prototyping and evaluation phase. No other source for these items currently exists. Developing another source for these items would be cost and schedule prohibitive. The total estimated cost to develop, test and evaluate a different product to satisfy this CAMS requirement is estimated at $1.5 million dollars, and the lead time associated with the development, test and evaluation of this requirement is estimated at 18 months. Therefore, it is in the Government’s best interest to award on a HUBZone sole source basis to UEI.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The proposed contract was synopsized via posting on the Federal Business Opportunities (FEDBIZOPPS) website on 8/17/2018 in accordance with FAR 5.2. The synopsis expressed the government’s intent to contract on a sole source basis.

There have been no inquiries to this synopsis. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than UEI, the Original Equipment Manufacturer (OEM), to provide the equipment and repairs.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined the anticipated cost to the Government for the supplies and services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

Due to significant engineering costs and long lead time for development described under paragraph 5 above, there are no actions taken by the LCAC program to remove the barrier to competition.
