MEMORANDUM
From: E. Branham, NSWC PCD Code E42 To: Dr. Luis R. Gely, NSWC PCD Code 024
Subj: SOLE SOURCE JUSTIFICATION TO ACQUIRE (1) AXYS TECHNOLGIES INC. WATCHKEEPER WAVE BUOY (Purchase Request: 1300613156
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 024).
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order to AXYS Technologies Inc.
(cage code L0379), 2045 Mills Road, Sidney, British Columbia, Canada to acquire Watchkeeper Wave Buoy System.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The following items are being acquired:
Part Number Item Description Qty WKB Watchkeeper wave buoy system 1 TECHSUP On-site AXYS technician support 1
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. The estimated value of this effort is not to exceed $103,566. Equipment will be delivered and installed within 60 days after award of purchase order. The contract action will be funded with Navy Working Capital Funds (NWCF).
4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. It is requested that this item is procured from AXYS Technologies Inc. to facilitate the compatibility with the existing
AXYS Watchkeeper Wave Buoy that is currently being utilized by the Coastal Test Range (E42) in the Range and Facilities Branch Oceanographic Support Office. These items and components are necessary for the continual and critical operation of the NSWC PCD Oceanographic Support Office. Wave buoys used to collect wave parameters (height, period, direction), and the procurement of these instruments are vital in support of NSWC PCD missions; in particular this buoy is used for monitoring waves in the offshore NSWC PCD operations area and will be deployed in a permanent mooring several nautical miles off of the beach, replacing the existing buoy NSWC PCD Code E42 owns now. As this exact buoy is currently in use, although at the end of its life cycle, spare parts that are already on hand (telemetry modems, solar panels, temperature sensors, etc.) will provide backwards and forwards compatibility, and integrating another 2-meter wave buoy system will greatly impact the ongoing personnel training and may change or introduce new parameters that may be detrimental to the Oceanographic Support Office. As such acquiring any other 2-meter wave buoy system will incur in recurring costs related to configuration management, user training, and mission protocols.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 4 above, for any company other than AXYS Technologies Inc. to provide the required equipment.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, AXYS Technologies Inc. is the only company that can provide the required equipment.

I certify that the facts and representations under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.
Jessica Haig on behalf of:
Elizabeth Branham NSWC PCD Code E42
