MEMORANDUM

Subj: SOLE SOURCE JUSTIFICATION TO ACQUIRE (2) DATAWELL BV DWR- G4 WAVE BUOYS (Purchase Request: 1300612291

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 024).

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order to Datawell BV, through Coastal Obs Tech Services LLC (cage code 6YP02), 3801 Shadow Lane, Virginia Beach, VA 23452 to acquire DWR-G4 Wave Buoy systems.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The following items are being acquired:

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. The estimated value of this effort is not to exceed $53,217. Equipment will be delivered and installed within 60 days after award of purchase order. The contract action will be funded with Navy Working Capital Funds (NWCF).

4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. It is requested that these items are procured from Datawell BV, through Coastal Obs Tech Services LLC (United States representative to Datawell BV) to facilitate the compatibility with the existing Datawell

Wave Rider Buoy that is currently being utilized by the Coastal Test Range (E42) in the Range and Facilities Branch Oceanographic Support Office. These items and components are necessary for the continual and critical operation of the NSWC PCD Oceanographic Support Office. Wave buoys used to collect wave parameters (height, period, direction), and the procurement of these instruments are vital in support of NSWC PCD missions. These highly portable wave buoys are desired because the OSO currently uses a larger Datawell Wave Rider Buoy and the OSO is familiar with the software applications and hardware intricacies, and integrating another portable wave buoy system will greatly impact the ongoing personnel training and may change or introduce new parameters that may be detrimental to the Oceanographic Support Office. In addition, the OSO already owns a Datawell RX-C receiver, and it is imperative these wave buoys are able to interface with the existing receiver to enable multiple wave buoys communicating with a single receiver. As such, acquiring any other portable wave buoy system will incur in recurring costs related to configuration management, user training, and mission protocols.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 4 above, for any company other than Datawell BV (through Coastal Obs Tech Services LLC) to provide the required equipment.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Datawell BV (through Coastal Obs Tech Services LLC) is the only company that can provide the required equipment.
