MEMORANDUM
From: V. Tran, NSWC PCD Code E25 To: L. Gely, NSWC PCD Code 024
Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE PACSTAR 1210 STANDARD SERVICE PLAN Renewal (PURCHASE REQUEST TBD)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 02).
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order, on a sole source basis, to acquire PACSTAR 1210 Standard Service Plan Renewal for the Navy Expeditionary Combat Command Enterprise Tactical Command and Control (NETC2) system.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The contract effort is to acquire the following:
Item Quantity Pacstar 1210(base year) 93 Pacstar 1210(option year 1) 93 Pacstar 1210(option year 2) 93 Pacstar 1210(option year 3) 93
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. The estimated value of this effort is not to exceed $699,081. All equipment will be delivered no later than ninety (90) days after award of the order. The contract action will be funded with SPAWAR internal direct cite funds.
4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
This acquisition is conducted under the authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Service Act of 1949 (41 U.S.C. 251, et seq. and 40
U.S.C. 501). An order for the supplies described in section 3 will be placed pursuant to the authority of FAR 8.405-6. The Naval Expeditionary Combat Command Expeditionary Tactical Combat Command (NETC2) project delivers a system that enables a commander to set up a self-contained command and control (C2) system anywhere in the world. NETC2 provides a standardized, integrated, rapidly deployable, modular, scalable and reconfigurable C2 system to support operations ranging from a small early entry forward component up to and including Combined Task Force (CTF) operations. The system is designed to provide commanders a mission critical, integrated family of systems with which to plan, control, coordinate, execute, and assess operations across the spectrum of conflict.
A fully fielded NETC2 system includes: shelters; infrastructure; trailers; communications equipment (to support nested en route and early entry operations only), Government-off-the-shelf (GOTS) C2 and commercial-off-the-shelf (COTS) office automation and collaboration software applications with operator workstations; displays; intercommunications; local area networks; and access to wide area networks.
This procurement is sole source specific for the following reasons:
• PACSTAR is currently in operational use by the Joint Communications Support Element (JCSE). The PACSTAR design utilizes an “Everything over Internet Protocol (EoIP)” approach.
This same design is outlined in Defense Information Systems Agency (DISA) Global Information Grid (GIG) Convergence Master Plan and is based on the use of the “black core” network. This network design is unique and requires special equipment at the receiving end of the satellite link. JCSE has provided DISA Standard Tactical Entry Point (STEP) sites around the world with the equipment necessary to operate on the black core.
• The PACSTAR 1210 is part of the entire RRK and is integral to its operation. The Rapid Response Kit (RRK) system has received an Approval to Operate (ATO) from Naval Network Warfare Command and has been certified through interoperability certification.
• The PACSTAR 1210 Standard Service Plan Renewal provides support for the Pacstar 1210 currently in use by the project. A significant investment has been made in the original procurement of the PACSTAR 1210 Appliance. Renewal of the service plan will allow the engineers to maintain service on the current PACSTAR 1210 equipment.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 4 above, for any company other than Pacstar to provide the standard service plan.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, the PACSTAR Standard Service Plan is the only product that can meet the requirement.
TECHNICAL AND REQUIREMENTS REQUESTING OFFICIAL
I certify that the facts and representations under my cognizance, which are included in this justification and its supporting acquisition planning data, except as noted herein, are complete and accurate to the best of my knowledge and belief.
