4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements, IAW with FAR 6.302-1(a)(2)(ii.
5. Rationale Justifying Use of Cited Statutory Authority
NSWC PCD is the design authority for the LCAC HM&E systems. The parts being purchased are items manufactured by Magellan Aerospace. This purchase is not suitable for full and open competition for the following reasons:
a. Of the items being purchased, those with NSNs were either unavailable in MILSTRIP or had lead times of 18 months or more which does not support the LCAC repair schedules.
b. Magellan Aerospace is the Original Equipment Manufacturer (OEM) for the parts needed and is the only distributor of these parts. The items are on a make to order basis. As the OEM for the parts needed, Magellan Aerospace is the only Navy approved vendor that has made these items in the past according to specific form, fit, and function requirements for
LCAC.
c. Similar items were previously purchased under contract N61331-14-C-0023, on a Sole Source basis from Magellan Aerospace valued at $290,612. The procurement was supported by J&A #4119-0025.
d. Developing another source for these items would be cost and schedule prohibitive; it would be very expensive as there would be significant engineering and testing costs incurred (First Article inspection costs) as well as special tooling and capabilities requirements for the manufacturer. It is estimated that it would take another vendor twenty five months to manufacture and deliver the required parts for the Government to test same. The estimated cost associated with Government testing is $350,000. Award to any other source would result in a duplication of cost to the Government that is not expected to be recovered through competition.
Based on the above, Magellan Aerospace is the only source that can meet the LCAC HM&E requirements for the propeller and shroud parts.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
This acquisition was synopsized and posted on the Federal Business Opportunities (FEDBIZOPPS) website on 17 Mar 2015 as required by FAR
5.2. The synopsis expressed the government’s intent to contract on a sole source basis and included instructions for vendors wishing to qualify their products for future requirements. As of 1 April 2015, there were no inquiries to the synopsis. A Sources Sought notice was posted May 21, 2015 in which one request for drawings was received from Top Flight Aerostructures,Inc. The Sources Sought closed on June 1, 2015 with no responses from Top Flight Aerostructures,Inc. or any other vendor. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Magellan Aerospace, the OEM, to provide the equipment.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine that the anticipated prices to the Government, for the supplies and services covered by this J&A, will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWC-PCD has no plans at this time to compete future contracts for the types of supplies/ services covered by this document. If another potential source emerges, NSWC-PCD Contracts Department will assess whether competition for future requirements is feasible.
