LIMITED-SOURCES JUSTIFICATION AND APPROVAL
Justification
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Panama
City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-
7001 (Contracts Department
2. Description of the Action Being Approved
This action will grant procurement, on a limited source basis, to L-3
Communications (GCS), 7640 Omnitech Place Victor, NY 14564-9782 to acquire Hawkeye III Lite Spares for the Deployable Joint Command and
Control (DJC2) Rapid Response Kits (RRK) and Sensitive Compartmented
Information Kits (SCIK) spares for the Expeditionary Command and
Control Suite (ECCS).
3. Description of Supplies/Services
The DJC2 RRK and SCIK provide limited Rapid Response communication capability to include Super High Frequency (SHF) Satellite
Communications (SATCOM), Ultra High Frequency (UHF) Tactical Satellite
(TACSAT), and global handheld satellite phones for situational awareness, planning, and other command and control functions. The kits integrate capability to provide communications via reach back through the access of up to two data networks (Secret Internet
Protocol Router Network [SIPRNet], Unclassified but Sensitive Internet
Protocol Router Network [NIPRNet], Combined Enterprise Regional
Information Exchange System [CENTRIX], and Non-Government Organization
[NGO]) simultaneously. The kits are capable of selectable scaling from 2 to 15 operator position configurations and will operate on standard electrical power sources. The kits can also deploy and operate with small lightweight generator power sources.
The RRK and SCIK both utilizes one (1) the Hawkeye Tri-Band Antenna.
The L-3 Hawkeye III Lite is a 1.2 meter Tri-Band (X-Band, Ku-Band and
Ka-Band) capable satellite antenna.
This procurement is for L-3 GCS Hawkeye III Lite spares in support of the existing RRK and SCIK which is required to support fleet/warfighter deployment and use.
The contractor shall deliver the following equipment as spares:
Nomenclature Part Number Quantity
H3L 1.2M Auxiliary X-Band Kit 40W, (Color: Tan)
1512X-RK-040T 12
Low Noise Block (LNB) – (X-Band), (Color: Tan)

The Government’s minimum requirement needs have been certified by the requiring technical authority. The estimated value of this effort is
$1,100,000.00. The contract will be funded 100% with Fiscal Year (FY)
2013 - 2015 Procurement Marine Corp (PMC) funds. The expected delivery timeline for the base quantities is sixteen (16) weeks after award.
4. Statutory Authority Permitting Other Than Full and Open Competition
Pursuant to the authority of the Multiple Award Schedule Program, Title
III of the Federal Property and Administrative Service Act of 1949 (41 U.S.C.
251, et seq.) and Title 40 U.S.C. 501 Services for Executive Agencies, a delivery order for the spare parts described in Section 3 will be placed in accordance with FAR 8.405-6(a)(1)(i)(B).
5. Rationale Justifying Use of Cited Statutory Authority
This requirement is not suitable for full and open competition. Use of this specific Hawkeye III Lite product is required due to the following conditions:
The original antenna used reached end-of-life. In FY2011, the government completed an engineering evaluation study for technical refresh components. During the engineering evaluation study, As discussed in the ECCS Acquisition Strategy/Acquisition Plan (AS/AP) dated November 2012, it is anticipated the procurement for additional spares will utilize other than full and open competition contracting approach in order to maintain the product baseline.
The ECCS Acquisition Strategy/Acquisition Plan (AS/AP), dated November 2012, also discussed the Hawkeye III Lite and spares are part of the Rapid Response Kit (RRK) and Sensitive Compartmented
Information Kits (SCIK) and is integral to its operation. The AS/AP plan also specifies, “The Hawkeye III Tri-band Antenna will be procured for each RRK & SCIK. The RRK & SCIK system received an
Approval to Operate (ATO) on 02 February 2011, from Naval Network
Warfare Command and has been certified through interoperability certification. No other known solution has the required accredited
ATO, and certification for the DJC2 System. Substituting other antenna will invalidate the ATO and will invalidate any interoperability certification. The current ATO will expire on 28
January 2014.
The Hawkeye III Lite spares were previously purchased under contract N61331-13-F-5503, on a sole source basis from L-3 Communications
To procure equipment that is not accredited, will add an additional six months to the procurement process in order to allow for the accreditation and receive the Authority to Operate. This would lead to unacceptable delays and additional costs in fielding the Rapid
Response capability. The estimated time and cost to procure alternate equipment is as follows: three (3) additional months of engineering analysis (approximately $45,000), a Statement of
Difference (approximately $3,500), two (2) months for an evaluation by a Navy IA Validator (approximately $30,000), one (1) month Network scans for vulnerabilities (approximately $15,000); and accreditation process (approximately $32,000). Consequently, to test and accredit another antenna would cost the Government approximately $125,500.00.
These costs are based on the level of effort required for the previous accreditation process that was completed in FY2011. This cost is not expected to be recovered through competition. Further, this hardware is only available from the original equipment manufacturer (OEM) – they do not sell through resellers or distributors.
Based on the above, L-3 Communications is the only source that can meet the DJC2/ECCS requirement.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
FAR 8.404(a) does not require a synopsis for an order placed under a
GSA Schedule; therefore, this action will not be synopsized. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than L-3 Communications, the OEM, to provide the spare parts.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine the anticipated prices to the
Government, for the supplies and services covered by this J&A, will be fair and reasonable.
8. Actions to Remove Barriers to Competition
During the next scheduled technology refresh, designated to take place
FY16-18 (per the AS/AP), products from potential sources, identified as specified in paragraph 6 above and through market research, will be tested for form, fit and function capabilities. Proven products will be submitted for certification.
