52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

Factor 1:

Technical Capability

· Sampling Kit

· Facilities

· Quality Assurance/Inspection System

· Website

Factor 2:

Key Personnel Resume

Factor 3:

Past Performance

Factor 4:

Price Factors 1, 2, and 3, and 4 are equal in importance.

1. The Government intends to make award using the Lowest Price Technically Acceptable Source Selection Process.

2. The Government intends to make award on the basis of initial proposals without conducting discussions, but reserves the right to conduct discussions if determined necessary (See FAR 52.215-1 ALT I). Offerors are advised to offer their most favorable terms and conditions in their initial proposal submission. Therefore, each initial offer should contain the Offerors best terms from a price and technical standpoint.

3. Offerors are advised that with the exception of the Sampling Kit(s) submitted with the proposal, the Government will not evaluate any information not contained within the body of the proposal. Letters of transmittal and/or cover letters that forward the proposal to the Government are not considered part of the body of the proposal.

4. The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for basic and option items. An unbalanced offer is one, which is based on costs significantly less than cost for some work and/or significantly overstated for other work. Offerors are advised that a proposal containing unrealistic technical or schedule assertions or unrealistically low prices will be deemed indicative of a lack of technical understanding or a failure to comprehend the complexity and risks of the contract requirements and consequently may make the proposal unacceptable.

5. Offers submitted on a basis other than F.O.B. Destination shall be rejected as unacceptable.

6. Award will be made to the offeror who is deemed responsible in accordance with FAR 9.104; whose proposal conforms to the solicitation's requirements and is judged to be technically acceptable to the Government, and whose prices are deemed fair and reasonable.

7. The Government may contact government and commercial references submitted by Offerors and may use information in its files to verify information provided within the Offerors proposal.

EVALUATION OF TECHNICAL PROPOSALS

The Government has determined that the technical factors are equal in importance. The Technical Evaluator(s) will evaluate the proposals as specified in this clause for whether or not they have met the requirements specified in the Addendum to FAR 52.212-1, Instructions to Offerors and the Addendum to FAR 52.212-4, Performance Work Statement (PWS). The Offeror will be evaluated on an “ACCEPTABLE or UNACCEPTABLE” basis. Any proposal that is found to be “UNACCEPTABLE” in any factor of the Technical proposal may result in the entire Proposal being deemed unacceptable.

In order to be considered awardable, there must be an “acceptable” rating in every non-price factor.

The Government reserves the right to conduct a pre-award survey on any offeror found to be technically acceptable.

The following adjectival ratings/definitions shall be used for the evaluation of Factors 1 and 2.

Table 1: TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS

Rating
Description
Acceptable
Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable
Proposal does not clearly meet the minimum requirements of the solicitation.

The following adjectival ratings/definitions shall be used for the evaluation of Factor 3.

Table 2: PAST PERFORMANCE EVALUATION RATINGS

Rating
Description
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (see note below).
Unacceptable
Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

*Note* In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.

Factor 1 Technical Capability:

BASIS FOR EVALUATION: Factor 1 will be evaluated as an overall factor with no subfactors. Factor 1 will be determined technically acceptable if:

1. The offeror’s submitted Sampling Kit is capable of testing inside and outside confined spaces and:

- is correctly labeled and and packaged to ensure cleanliness of sampling equipment is maintained and that sampling equipment is not damaged during shipment to or from the field activity,

- remains intact with no damage or breakage when dropped once on each side from a height of 36 inches onto a flat, concrete floor,

- has a unit number for identification,

- contains pictogram testing instructions that are easy to read, one page, wipe off plastic, and clear and precise,

- contains an inventory list of all items in the air sample kit and the equipment in the kit matches the inventory list, and

- incorporates a tamper proof method for indicating whether the sample containers were used or not used.

The Government will evaluate the Sampling Kit(s) in accordance with the evaluation factors. The Sampling Kit will be utilized by Navy personnel simulating typical air sampling operations. The Government will exercise due diligence when using the sample kit. However, the Sampling Kit may be damaged during normal use.

2. The offeror’s Facilities proof of lab accreditation in accordance with ISO/IEC 17025-International Standards Organization General Requirements for the Competence of Testing and Calibration Laboratories dated 15 May 2005 and the equipment/instrumentation that the offeror identifies for use on a contract resulting from this RFP in accordance with the specifications of this solicitation;

3. The offeror’s summary of its:

- Quality System and Quality Assurance Program Plan meet the requirements of ISO 9001:2008 and ISO/IEC 17025-International Standards organization—General Requirements for the Competence of Testing and Calibration Laboratories 15 May 2005 and include sufficient quality controls to perform the tasks of this solicitation.

- Configuration Management Plan meets the requirements of the TECHAMERICA EIA-649-B-2011 Configuration Management Standard.

- Equipment Calibration Plan meets the requirements of ISO/IEC 17025 – International Standards organization—General Requirements for the Competence of Testing and Calibration Laboratories 15 May 2005.

4. The offeror’s description of its approach for the website as a minimum indicates the website:

- will have the capability for field activities to log in securely, place sampling kit orders, maintain a current list of all testable equipment at the field activity, and maintain all analysis reports for their activity,

- will have the capability to allow group sponsors, as identified by the COR, to log in securely to view air sampling status of their group, and

- will have a dedicated page for the COR to log in securely to authorize shipment of Sampling Kit orders.

Factor 2 Key Personnel Resumes BASIS FOR EVALUATION: Factor 2 will be evaluated as an overall factor with no subfactors. Factor 2 will be determined technically acceptable if the Offeror proposed the required key personnel and the Key Personnel Resume meets the minimum requirements.

Factor 3 Past Performance

BASIS FOR EVALUATION: Factor 3 will be evaluated as an overall factor with no subfactors. The past performance evaluation results in an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements; and, is based on the offeror’s record of recent and relevant past performance information that pertain to the solicitation requirements. There are two (2) aspects to the past performance evaluation. The first is to evaluate whether the offeror’s present/past performance is relevant or not relevant to the effort to be acquired. The second is to determine how well the contractor performed on the contracts.

Recent past performance is defined as occuring within the past three (3) years. Relevant is defined as a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.

To determine how well the contractor performed on the contracts, the Government will verify no negative reports are found in data from other customers, the DoD Past Performance Information Retrieval System (PPIRS), NAVSEA Product Deficiency Reporting (PDREP) system, other Government contractors, the Environmental Protection Agency, the Department of Labor, consumer protection organizations, etc.

EVALUATION OF PRICE PROPOSALS

Factor 4 Price

1. The Price Proposal will be evaluated to determine that the total evaluated price is fair and reasonable.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

AWARD DETERMINATION

Award will be made on the basis of the lowest total evaluated price among the proposals having “acceptable” ratings for every non-price factor.

AWARD BY FULL QUANTITY

An offeror must quote on all items in this solicitation to be eligible for award. Proposals shall be valid through April 20, 2015, unless an extension is requested by the Contracting Officer.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
